How to punish fraudulent retirement?

Penalties for falsely claiming pensions:

1. If a retiree fails to report his death, and his relatives or others impersonate the pension, the social insurance agency shall order the impersonator to return the pension, and the labor administrative department shall punish him according to law, and impose a fine of not less than two times but not more than five times the amount defrauded;

2. For those who refuse to refund the defrauded amount, the social insurance agency shall apply to the people's court for compulsory execution.

Ways of receiving pension after social security retirement:

1. One month before the insured reaches the statutory retirement age (special type of work and early retirement due to illness need to apply for review or labor ability appraisal three months in advance), the insured or the social security administrator of his unit shall submit the relevant information of retirement application to the social security agency;

2, social security institutions to review the information provided by the insured, and meet the conditions of receiving monthly benefits, issued a "retirement certificate", from the next month on a monthly basis to pay basic pensions;

3. After receiving the employee retirement card 15 days, the insured person will bring his ID card, social security card and retirement card to the designated bank to issue a pension debit card and provide an account to the social security agency. The social security department will pay the pension to your designated account every month according to the regulations.

Legal basis: Article 88 of People's Republic of China (PRC) Social Insurance Law.

Whoever defrauds social insurance benefits by fraud, forgery of certification materials or other means shall be ordered by the social insurance administrative department to return the defrauded social insurance benefits, and a fine of not less than two times but not more than five times the amount defrauded shall be imposed.
