Legal basis: Article 97 of People's Republic of China (PRC) Social Insurance Law. Foreigners employed in China shall participate in social insurance with reference to the provisions of this Law. Foreigners refer to those who do not have China nationality according to the Nationality Law, including those with foreign nationality and stateless persons. Residents of Taiwan Province Province, Hong Kong residents and Macao residents belong to China citizens, and the Regulations on the Administration of Employment of Hong Kong and Macao Residents in Taiwan Province Province in the Mainland shall apply, and social insurance premiums shall be paid in accordance with the Provisional Regulations on the Collection and Payment of Social Insurance Fees, but the provisions of this article shall not apply.
