Fake separation certificate can be found out. If an employee leaves a job, the unit needs to issue a certificate of separation in accordance with the law and handle the transfer of files and social security for the employee. The employee, in turn, is required by law to carry out the transfer of work. Neither party can forge the certificate of separation.

Legal Objective:

Article 50 of the Labor Contract Law provides that the employer shall issue a certificate of termination of the labor contract and transfer the files and social insurance relations for the worker within fifteen days of the termination of the labor contract. The laborer shall, in accordance with the agreement between the two parties, handle the handover of work. Where the employer is required to pay economic compensation to the worker in accordance with the relevant provisions of this Law, it shall do so at the time of handing over the work. The employer shall keep the text of the canceled or terminated labor contract for at least two years for reference.
