Article 30 of the Social Insurance Law of the People's Republic of China excludes the following medical expenses from the scope of payment by the basic medical insurance fund: (1) those that should be paid from the Workmen's Compensation Insurance Fund; (2) those that should be borne by a third party; (3) those that should be borne by the public health authorities; and (4) those that are incurred outside China. If the medical expenses should be borne by a third person in accordance with the law, and the third person does not pay or the third person cannot be identified, the basic medical insurance fund shall pay in advance. The basic medical insurance fund shall have the right to recover the costs from the third party after making the payment in advance.

Objective law:

Article 28 of the Social Insurance Law of the People's Republic of China is in line with the basic medical insurance drug directory, diagnostic and therapeutic items, standards of medical services and facilities, as well as emergency and rescue medical expenses, in accordance with state regulations from the basic medical insurance fund. Article 29 of the Social Insurance Law of the People's Republic of China (PRC) states that the portion of the medical expenses of insured persons that should be paid by the basic medical insurance fund shall be settled directly between the social insurance administration organization and the medical institutions and drug business units. The social insurance administrative department and the health administrative department shall establish a settlement system for medical expenses for medical treatment in other places, so as to facilitate the enjoyment of basic medical insurance treatment by insured persons.
