Is the suspension (interruption) a layoff?

Suspension of payment (interruption) and layoffs depend on the situation, as follows:

1, social security payment is a state that employees can't pay their fees in time due to various reasons, and they may or may not be on the job;

2. Social security attrition refers to the fact that employees have to stop participating in insurance because of leaving their jobs and must be unemployed.

3. The suspension and reduction of social security has no effect on the insured employees. The difference between suspending social security and layoffs is as follows:

(1) In different ways, social security suspension means that social security payment will be suspended and then re-paid, and downsizing means that the set quota has been lifted;

(2) In different forms, social security suspension refers to the state that employees can't pay their fees in time due to various reasons, which may be on-the-job or off-the-job. Social security attrition means that employees need to stop insurance because they leave their jobs, which is definitely not worth it anymore.

Laws and regulations: Article 9 of the Provisional Regulations on the Collection and Payment of Social Insurance Fees.

If the payer's social insurance registration items are changed or the payer is terminated according to law, it shall go through the formalities for the change or cancellation of social insurance registration at the social insurance agency within 30 days from the date of change or termination.

Article 10

Payment units must declare the amount of social insurance premiums payable to social insurance agencies on a monthly basis, and pay social insurance premiums within the prescribed time limit after being approved by social insurance agencies.

If the payer fails to declare the amount of social insurance premiums payable in accordance with the regulations, the social insurance agency shall temporarily determine the amount payable according to 1 10% of the amount paid by the unit last month; If there is no amount paid last month, the social insurance agency shall temporarily determine the amount to be paid according to the operating conditions of the unit and the number of employees. After the payer completes the declaration procedures and pays the social insurance premium according to the approved amount, the social insurance agency shall settle the account according to the regulations.

Article 11

Where the people's governments of provinces, autonomous regions and municipalities directly under the Central Government stipulate that social insurance premiums shall be collected by the tax authorities, the social insurance agency shall provide the tax authorities with the social insurance registration, change of registration, cancellation of registration and payment declaration of the payer in a timely manner.
