Legal basis

Social Insurance Law, Article 2, the State establishes a social insurance system of basic old-age insurance, basic medical insurance, industrial injury insurance, unemployment insurance, maternity insurance and other social insurance systems, to protect the citizens' right to receive material assistance from the State and society in old age, sickness, industrial injury, unemployment, maternity and other situations in accordance with the law. Article 4 of the Social Insurance Law stipulates that employers and individuals within the territory of the People's Republic of China shall, in accordance with the law, pay social insurance premiums, and shall have the right to enquire about the records of payment of premiums and the records of individual rights and interests, and to request that the social insurance administration organizations provide social insurance counselling and other relevant services. Individuals enjoy social insurance benefits in accordance with the law, and have the right to supervise the unit for their contributions.
