According to the law, during the existence of labor relations, the employer shall pay social insurance for workers according to law. The probation period is a part of the labor contract and belongs to the duration of labor relations, so social security needs to be paid during the probation period.

The probation period is usually after the new employee joins the company. Because employers don't know much about employees' actual working ability and working attitude, they will set a certain period of probation to observe and assess whether employees meet the job requirements.

Provisions on probation period:

1. The probation period in the labor contract shall be agreed by both the employer and the employee through equal consultation, and shall not be imposed by the employer;

2. The longest probation period shall not exceed 6 months;

3. If the term of the labor contract is more than three months but less than one year, the probation period shall not exceed one month; If the term of the labor contract is more than one year but less than three years, the probation period shall not exceed two months; For labor contracts with a fixed term of more than three years and without a fixed term, the probation period shall not exceed six months;

4. The probation period is included in the term of the labor contract, and the probation period cannot be counted out of the labor contract, that is, the labor contract is signed after the probation period expires. If the labor contract only stipulates the probation period, the probation period is not established, and this period is the term of the labor contract;

5. The same employer and the same worker can only agree on a probation period. The probation period is applicable to workers who change their posts or types of work after initial employment or re-employment, and can only be tried once for workers whose posts have not changed. When the labor contract is renewed, if the employee changes the job type, the probation period can be re-agreed, and if the job type is not changed, the probation period will no longer be agreed.

Article 58 of the Social Insurance Law

The employing unit shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for its employees. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay.

Employees-free individual industrial and commercial households who voluntarily participate in social insurance, part-time employees who do not participate in social insurance in the employing unit and other flexible employees shall apply to the social insurance agency for social insurance registration.
