Labor dispatch workers to pay social security

The social security of labor dispatch workers is paid by the dispatching unit, and is generally withheld and paid by the dispatching unit in the salary. Because the employer of labor dispatch workers is the dispatch company, and social security is generally paid by the employer, so it should be paid by the dispatch unit.

Article 18 of the Interim Provisions on Labor Dispatch

If a labor dispatching unit dispatches workers across the region, it shall participate in social insurance for the dispatched workers in the location of the employing unit, and pay the social insurance premiums in accordance with the regulations of the location of the employing unit, and the dispatched workers shall enjoy the social insurance treatment in accordance with the state regulations.

Article 19 of the Interim Provisions on Labor Dispatch

If a labor dispatching unit establishes a branch office in the place where the employing unit is located, the branch office shall go through the procedures of enrolling the dispatched workers in social insurance and pay the social insurance premiums.

If the labor dispatching unit does not set up a branch in the place where the labor employing unit is located, the labor employing unit shall handle the insurance procedures for the dispatched workers on behalf of the labor dispatching unit and pay the social insurance premiums.
