How to ask the company to pay social security?

If the company is required to pay back the social security, employees do not need to provide any materials, and the company needs to submit the following materials:

1, employee files and social insurance personnel repayment declaration form;

2. The original labor contract signed by the employer and the employee;

3. The original payroll and a copy of the official seal of the employee during his/her work in this unit;

4. During this period, employees need to return the original accounting vouchers of the unit.

During the period of labor relations between employees and the unit, if the unit fails to pay social security to the employees, the employees may ask the unit to pay back. On-the-job employees can negotiate with the unit, and those who leave the company need to negotiate with the unit within one year after leaving the company and ask for remuneration. If negotiation fails, you can apply to the local labor inspection for labor arbitration and claim that the unit pays social security. If the employee and the employer decide to pay social security by the company through negotiation, mediation, arbitration, etc., the employer shall bring the original and photocopy of the transfer order of the labor or personnel organization department, the original and photocopy of the employee's ID card, professional title certificate and other materials to the local social insurance agency to pay.

The employee requires the company to pay back the social security process:

1, the payment shall be made within 6 months, handled by the local tax department, and paid by the social security department for more than 6 months.

2. Social security payment process and materials: firstly, apply for payment to the social security bureau branch to which the unit belongs, submit materials (original and photocopy of the insured's ID card, social security of the unit, labor contract, accounting voucher for salary payment, original and photocopy of the agent's ID card), fill in the form, pay the local tax with the payment confirmation form issued by social security after approval, and transfer the materials to social security after successful payment.

Article 63 of People's Republic of China (PRC) Social Insurance Law

If the employer fails to pay social insurance premiums in full and on time, the social insurance premium collection agency shall order it to pay or make up within a time limit.

If the employer fails to pay or repay the social insurance premium within the time limit, the social insurance premium collection agency may inquire about its deposit account in banks and other financial institutions; And can apply to the relevant administrative departments at or above the county level to make a decision on the allocation of social insurance premiums, and notify their bank or other financial institutions in writing to allocate social insurance premiums. If the balance of the employer's account is less than the social insurance premium that should be paid, the social insurance premium collection agency may require the employer to provide guarantee and sign a deferred payment agreement. If the employer fails to pay the social insurance premium in full and fails to provide guarantee, the social insurance premium collection agency may apply to the people's court for sealing up, distraining and auctioning the property whose value is equivalent to the social insurance premium that should be paid, and the proceeds from the auction will be used to offset the social insurance premium.

Paragraph 3 of Article 6 of the Interim Provisions on Payment of Wages stipulates that the written records of employees' wages paid by employers can only be kept for more than two years for future reference.
