What is rural social security?

Rural social insurance has the following meanings:

1. The establishment of rural social endowment insurance system will make constitutional rights a concrete legal right. When the right of material assistance stipulated in the Constitution becomes the legal right of citizens, a specific relationship of rights and obligations will be formed between citizens and the corresponding administrative organs. In this case, it is a citizen's right to ask for material rewards and help. The relevant administrative organs have the obligation to provide material remuneration and legal aid. If the relevant administrative organs fail to fulfill this legal obligation according to law, citizens can seek administrative and legal remedies;

2. The rural social endowment insurance system is a legal system that transforms farmers' constitutional rights into real rights. Once it is established, it is necessary for the state and society to solve the social pension problem of farmers through affirmative and clear norms from the perspective of safeguarding the Constitution, so as to ensure the basic life and pension needs of elderly farmers. Rural social insurance should be an important part of China's social insurance system, and the legal status of rural social endowment insurance construction should be clarified legally. It is necessary not only to establish the urban social insurance system, but also to implement the rural social endowment insurance, making it an organic part of the national social insurance system and protected by law.

Legal basis: Article 10 of the Social Insurance Law of People's Republic of China (PRC).

Employees shall participate in the basic old-age insurance, and the employer and employees shall jointly pay the basic old-age insurance premium.

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic old-age insurance in the employer and other flexible employees can participate in the basic old-age insurance, and individuals pay the basic old-age insurance premium.

The measures for the endowment insurance of civil servants and staff managed by reference to the Civil Service Law shall be formulated by the State Council.

Article 11

The basic old-age insurance combines social pooling with individual accounts.

The basic old-age insurance fund consists of employers, individual contributions and government subsidies.

Article 12

The employing unit shall pay the basic old-age insurance premium according to the proportion of the total wages of its employees stipulated by the state, and record it in the basic old-age insurance pooling fund.

Employees shall pay the basic old-age insurance premium in accordance with the proportion of wages stipulated by the state and record it in their personal accounts.

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic old-age insurance in the employing unit and other flexible employees who have participated in the basic old-age insurance shall pay the basic old-age insurance premiums in accordance with state regulations and record them in the basic old-age insurance pooling fund and individual accounts respectively.
