Flexible employment was introduced in 2009.

Flexible employment is not part of the normal standard labor and employment situation in general enterprises and institutions, mainly engaged in temporary or flexible work of the employment of people. For example: shopkeepers who open online stores, street vendors, not go out to work at home with children's baby mama and so on. There are also freelancers who are engaged in professional activities in their personal capacity, who don't need to commute from 9 to 5 and can arrange their own working hours, as long as they provide specific work content according to the negotiation requirements with the working party, such as writers, singers, and models, and so on. Hourly workers are also considered to be flexible workers.

Additionally, flexible workers need to be certified, and there is a professional process that begins with a first review of the community's human resources center and the filling out of an application form, which is then submitted to a higher level of authority by the relevant staff.

Legal basis

The Chinese People's **** and State Insurance Law stipulates

Article 10

Employees shall participate in basic pension insurance, and shall pay the basic pension insurance premiums by the employing unit and the employees **** together.

Individual industrial and commercial households without employees, part-time workers who do not participate in basic pension insurance with their employing units, and other flexibly employed persons may participate in basic pension insurance and pay basic pension insurance premiums by themselves.

The methods of pension insurance for civil servants and staff members administered under the civil service law shall be prescribed by the State Council.

Article 12

Employers shall pay basic pension insurance premiums in accordance with the proportion of the total wages of the employees of the organization prescribed by the State and credited to the Basic Pension Insurance Coordination Fund.

Employees shall pay basic pension insurance premiums in accordance with the proportion of their own wages prescribed by the State and credited to their individual accounts.

Individual industrial and commercial households without employees, part-time workers who do not participate in basic pension insurance with their employers, and other flexibly employed persons who participate in basic pension insurance shall pay basic pension insurance premiums in accordance with the state regulations, which shall be credited to the Basic Pension Insurance Coordination Fund and to their individual accounts respectively.

Article 23

Employees shall participate in the basic medical insurance for employees, and the employing unit and the employees shall pay the basic medical insurance premiums together in accordance with the state regulations***

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic medical insurance for employees in their employing units, and other flexibly employed persons may participate in the basic medical insurance for employees, and the individuals shall pay the basic medical insurance premiums in accordance with the state regulations***.
