Who will pay the social security unit after leaving the company?

Legal analysis: each company has its own regulations on who will pay social security in the month when employees leave their jobs:

(1) If it is stipulated that employees must finish it in one month, otherwise the part handed in by the unit will also be borne by the individual;

(2) If the employee leaves the company before the specified date of 15, the reduction will be made in the current month, and the original company will not pay the social security for the current month. If you leave your job after the date of 15, it will be reduced next month, and the original company will still pay the social security for employees in that month.

How to pay social security after leaving the company: employees have two choices when leaving the company: re-employment in a new company or flexible employment.

(1) to work in a new company:

After leaving the company, the former unit will report the reduction of staff to the Social Security Bureau. If the new unit does not change its land, the employees only need to report the original social security number to the new work unit as social security personnel.

If the new unit is in a different place, it shall first take the original and photocopy of my ID card, the certificate of resignation (stamped with the official seal of the unit) and the social security card to the Social Security Bureau of this Municipality to receive the Certificate of Insurance Payment, and then I or the new unit shall go to the local area to handle the transfer of social insurance relationship.

(2) Flexible employment:

You can stop paying first, and the old-age insurance is paid when you retire 15 years, and you can get the pension. However, it is still not recommended to stop paying, for example, after the medical insurance is stopped, it cannot be reimbursed, or the conditions for buying a house and buying a car will be affected (in some places, the condition for buying a house and buying a car is to pay social security for five consecutive years).

You can also continue to pay social security insurance for flexible employees, but the part paid by the unit is borne by the individual.

Legal basis: Article 58 of the Social Insurance Law of People's Republic of China (PRC) stipulates that the employer shall apply to the social insurance agency for social insurance registration for employees within 30 days from the date of employment. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay.

Employees-free individual industrial and commercial households who voluntarily participate in social insurance, part-time employees who do not participate in social insurance in the employing unit and other flexible employees shall apply to the social insurance agency for social insurance registration.

The state establishes a national unified personal social security number. Personal social security number is a citizen's identity number.
