According to Article 37 of China's Regulations on Work-Related Injury Insurance, if an employee's work-related disability is assessed to be from Grade 7 to Grade 10, he or she shall be entitled to the following treatments:

(1) A lump-sum disability benefit shall be paid from the Work-Related Injury Insurance Fund in accordance with the grade of the disability, and the standard shall be as follows: 13 months of his or her own wages for Grade 7 disability, 11 months of his or her own wages for Grade 8 disability, 9 months of his or her own wages for Grade 9 disability, and 7 months of his or her own wages for Grade 10 disability. The standard is: 13 months' salary for Grade 7 disability, 11 months' salary for Grade 8 disability, 9 months' salary for Grade 9 disability, and 7 months' salary for Grade 10 disability;

(2) In case of termination of the labor or employment contract, or termination of the labor or employment contract proposed by the employee himself, the one-time medical benefit for the injury will be paid by the Work Injury Insurance Fund, and the one-time employment benefit for the disability will be paid by the employer. The specific standards for the one-time medical benefits for work-related injuries and the one-time employment benefits for disability are prescribed by the people's governments of the provinces, autonomous regions and municipalities directly under the central government.

Article 36 of the Regulations on Work-Related Injury Insurance, if an employee's work-related disability is determined to be a fifth- or sixth-degree disability, he or she shall enjoy the following treatment:?

(a) A one-time disability benefit is paid from the Workers' Compensation Insurance Fund according to the level of disability, at the rate of 18 months of one's salary for fifth-degree disability and 16 months of one's salary for sixth-degree disability;?

(2) retaining the labor relationship with the employer, the employer to arrange appropriate work. If it is difficult to arrange a job, the employer shall pay a monthly disability allowance at the rate of 70% of the salary for Grade 5 disability and 60% of the salary for Grade 6 disability, and the employer shall pay the social insurance premiums for the employee in accordance with the regulations.

If the actual amount of the disability allowance is less than the local minimum wage, the employer shall make up the difference. Upon the proposal of the injured worker, the worker may terminate or suspend the labor relationship with the employer, and the one-time medical allowance for work injury shall be paid by the Work Injury Insurance Fund, and the one-time employment allowance for disability shall be paid by the employer.
