Article 48
The expropriation of land shall be compensated fairly and reasonably, and the original standard of living of the farmers whose land has been expropriated shall be guaranteed without any reduction in standard of living, and their livelihoods shall be safeguarded in the long run. Land expropriation shall, in accordance with the law, pay in full and in a timely manner the compensation for land, resettlement subsidies, and compensation for rural villagers' dwellings, other aboveground attachments, and seedlings, as well as arrange for the social security expenses of the peasants whose land has been expropriated. The standards for land compensation and resettlement subsidies for expropriated agricultural land shall be determined by provinces, autonomous regions and municipalities directly under the Central Government through the formulation and publication of district comprehensive land prices. The comprehensive land price shall be formulated by taking into account such factors as the original use of the land, the conditions of the land resources, the value of the land, the location of the land, the relationship between the supply and demand of the land, the population, and the level of economic and social development, and shall be adjusted or re-published at least once every three years. Compensation standards for the expropriation of land other than agricultural land, ground attachments and seedlings shall be set by provinces, autonomous regions and municipalities directly under the central government. For rural villagers' residences therein, fair and reasonable compensation shall be given in accordance with the principles of compensation before relocation and improvement of living conditions, respecting the wishes of the rural villagers, and by means of rearranging the homesteads to build houses, providing resettlement houses, or monetary compensation, and compensating the costs of relocation and temporary resettlement due to expropriation, so as to safeguard the rights of the rural villagers to reside in their homes and to their lawful rights and interests to housing and property. Local people's governments at or above the county level shall include farmers whose land has been expropriated in the corresponding social security system for old-age pensions and the like. The social security expenses of farmers whose land is expropriated are mainly used to subsidize the social insurance contributions of eligible farmers whose land is expropriated, such as old-age insurance. The methods of raising, managing and utilizing the social security expenses of the expropriated farmers shall be formulated by the provinces, autonomous regions and municipalities directly under the central government.
