Chapter I General Provisions

Article 1 In order to meet the needs of urban heating system reform, ensure that enterprise retirees enjoy subsidies for heating costs, and safeguard the legitimate rights and interests of heating units and users, these measures are formulated in accordance with the Measures for the Administration of Urban Heating in Liaoning Province and relevant regulations.

Article 2 These Measures shall apply to all kinds of urban enterprises, private non-enterprise units (hereinafter referred to as employers) and their employees and retired (including retired, the same below) personnel with urban hukou in Zhongshan District, Xigang District, Shahekou District, Ganjingzi District and High-tech Industrial Park (inner city part) in the four districts of Dalian.

Article 3 The municipal government shall set up a special fund for subsidies for heating expenses of enterprise retirees.

Special funds for heating subsidies shall be raised in accordance with the principle of supporting fixed income and reasonable burden of employers, and shall be earmarked for paying heating subsidies for enterprise retirees.

Article 4 The municipal labor and social security administrative department is responsible for the collection and management of special funds for heating subsidies, and its specialized agencies are specifically responsible for the collection and distribution of special funds for heating subsidies, and the required funds are included in the fiscal budget.

Chapter II Fund Raising

Article 5 Sources of special funds for heating fee subsidies:

(1) Special funds for heating subsidies paid by the employer;

(two) the value-added income of special funds for heating subsidies;

(3) Failing to collect late fees as required;

(4) Other income.

Article 6 Since June 5438+ 10/day, 2006, the employer shall pay the heating fee subsidy special fund monthly according to the number of employees. The payment base is determined according to the average monthly salary of employees in our city last year, and the payment ratio is 2%.

All expenses required to pay special funds for heating subsidies shall be borne by the employer and charged before tax. Individual employees do not pay fees.

Article 7 Where the heating subsidies for retirees are paid by the agencies in a socialized way, the enterprise retirees, municipal enterprise retirees, municipal restructuring enterprise retirees and district enterprise retirees before the implementation of these Measures shall be paid by the enterprises according to the regulations.

Article 8 The retirees of bankrupt and liquidated enterprises and the survivors of deceased retirees who enjoy heating subsidies shall be paid by the enterprise in a lump sum according to the relevant regulations, and the required expenses can be solved from the income such as the realization of enterprise assets.

Article 9 The special funds for heating subsidies paid by the employing unit on a monthly basis shall be declared and paid to the agency before 10 every month. Fails to pay, in addition to the provisions of overdue payment, from the date of default, a daily surcharge of 2‰.

Tenth municipal government shall, according to the changes in the heating market and the income and expenditure of funds, adjust the payment standard of special funds for heating subsidies in a timely manner, and announce it to the public.

Chapter III Subsidies for Heating Fees

Eleventh employers pay special funds for heating subsidies in accordance with the regulations, and the heating subsidies enjoyed by retirees are paid from the special funds for heating subsidies in accordance with the regulations, and the agencies will implement monthly socialized distribution.

Twelfth retirees of the employing unit shall enjoy the heating subsidy in accordance with the payment period of special funds for heating subsidies after the implementation of these measures and the continuous length of service of urban enterprises in our city before the implementation of these measures. The specific calculation formula is as follows:

Monthly heating allowance for retirees = housing area standard × heating fee standard × 70%12.

Fourteenth in June 2006 1 after retirement from the employer, pay special funds for heating subsidies, February 2005 1 before working in urban enterprises in our city for a total of 25 years, according to the standard of housing area of 85 square meters to enjoy heating subsidies; Over 20 years and less than 25 years, enjoy heating subsidies according to the standard of housing area of 60 square meters; If it is less than 20 years, an individual can repay it for 20 years at one time. Do not pay, do not enjoy heating subsidies.

Article 15 Self-employed laid-off workers and unemployed people who have been transferred from state-owned enterprises after three years of reform approved by the municipal government, who used to work in urban enterprises in four districts of our city and have worked in urban enterprises in four districts of our city for 20 years after retirement, shall enjoy heating subsidies according to the standard of housing area of 60 square meters; If it is less than 20 years, an individual can repay it for 20 years at one time. Do not pay, do not enjoy heating subsidies.

Article 16 According to the post and level before retirement, enterprise retirees enjoy heating subsidies within the housing standards according to similar personnel in government agencies and institutions. Retirees who have no spouse or spouse without a job can enjoy the heating subsidy in full according to the housing area standard.

After the death of retirees, if their spouses are unemployed, they will continue to enjoy the heating subsidy in full according to the living standards of retirees; If the spouse has a job, he will enjoy the heating subsidy in full according to his housing area standard. The required expenses are paid by the original channel.

Article 17 After the death of a retiree, if his/her spouse meets the supporting conditions, has urban hukou in four districts of our city, and is not included in the coverage of heating subsidies for urban residents with difficulties, he/she can enjoy heating subsidies according to the housing area standard of 60 square meters.

Chapter IV Management, Supervision and Legal Responsibility

Eighteenth heating subsidies special funds into the financial accounts management, the implementation of two lines of revenue and expenditure, earmarking. No unit or individual may occupy, intercept or misappropriate. The financial department and the audit department regularly supervise and inspect the use and management of funds.

Nineteenth the employer shall announce the distribution of special funds for heating subsidies to employees every year, and accept the supervision of employees and trade unions. The agency shall regularly announce the income and expenditure of special funds for heating subsidies to the public and accept social supervision.

Article 20 The municipal labor and social security administrative department may inspect the payment by the employing unit according to law, and the inspected unit shall truthfully provide materials related to the payment of special funds for heating subsidies, and shall not refuse to inspect, and shall not conceal or make false reports. Entrusted by the administrative department of labor and social security, the agency may conduct relevant inspections on the collection of special funds for heating subsidies.

Twenty-first employers do not pay special funds for heating subsidies, and the administrative department of labor security shall pay them within a time limit; If the special funds for heating subsidies are not paid within the time limit, the administrative department of labor security may apply to the people's court for compulsory execution.

Twenty-second retirees heating subsidies have not been handed over to the agencies to implement social distribution, by the original employer in accordance with the provisions of payment.

Retirees or trade unions can complain to the administrative department of labor security if they fail to pay the fees in accordance with the regulations. After receiving a complaint, the administrative department of labor security shall order the employer to issue it within a time limit. If it fails to issue it within the time limit, the administrative department of labor security shall apply to the people's court for compulsory execution. If the restructured enterprise is not issued according to the regulations, the former state-owned assets management department may also bring a lawsuit to the people's court according to the contract for the transfer of state-owned property rights.

Twenty-third units and individuals who falsely report or impersonate heating fee subsidies shall be recovered by the administrative department of labor and social security and fined 1000 yuan. If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Chapter V Supplementary Provisions

Twenty-fourth enterprises that were originally located in four districts of the city and participated in endowment insurance in municipal endowment insurance agencies, their employees and retirees with urban hukou in four districts of the city may refer to these measures.

These measures are not applicable to "peasants".

Twenty-fifth other counties (cities) and pilot areas in our city may, according to the actual situation in the region, formulate measures for subsidies for heating costs for enterprise retirees in the region. Municipal enterprises (including bankrupt enterprises) located in counties (cities) shall be implemented in accordance with the relevant provisions of enterprise production and operation.

Article 26 These Measures shall come into force as of the date of promulgation.
