The employee's leave behavior will not affect the payment of social insurance premiums, and the employer must continue to pay the due part, and shall not refuse to pay because of the employee's leave behavior. If the employer refuses to pay, the laborer can complain to the local labor administrative department, which will order the employer to correct after verification, so that the employer can continue to pay social insurance premiums; Disputes arising from the payment of social insurance premiums may also be submitted to the local labor arbitration commission for arbitration, and the arbitration tribunal shall make a ruling according to law. If a party refuses to accept the ruling, it may also bring a civil lawsuit, and the people's court shall make a judgment according to law.
Legal basis: Article 60 of People's Republic of China (PRC) Social Insurance Law.
The employing unit shall declare itself and pay social insurance premiums in full and on time, and shall not postpone or reduce the payment except for legal reasons such as force majeure. The social insurance premiums that employees should pay shall be withheld and remitted by the employer, and the employer shall inform me of the details of paying social insurance premiums on a monthly basis.
Individual industrial and commercial households without employees, part-time employees who have not participated in social insurance in the employing units and other flexible employees can pay social insurance premiums directly to the social insurance premium collection agencies.
