Can you call the company to pay social security?

Legal analysis: if the two parties have not established a labor contract relationship, it is not allowed to pay social security only through affiliated institutions.

No unit or individual may obtain the qualification of social insurance participation and payment through fictitious labor relations or forged certification materials.

There are many similar regulations. Basically, all cities are not allowed to pay social security for affiliated units, and cities have been strictly paying social security.

The Interim Measures for the Administration of the List of Serious Untrustworthy Persons in the Field of Social Insurance issued by Ministry of Human Resources and Social Security shows that local human resources and social security departments at or above the county level will include employers, social insurance service institutions and their related personnel, insured persons and recipients of benefits in the list of serious untrustworthy persons in social insurance under any of the following circumstances:

(a) by fraud, forged documents or other means, illegal participation in social insurance, illegal handling of social insurance business for more than 20 times or profit of more than 20 thousand yuan.

(2) defrauding social insurance benefits or social insurance fund expenditures by fraud, forgery of certification materials or other means, and the amount exceeds 1 10,000 yuan, or refuses to return it even though it does not reach 1 10,000 yuan.

Legal basis: Article 58 of People's Republic of China (PRC) Social Insurance Law. The employing unit shall handle social insurance registration for employees within 30 days from the date of employment. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay. Employees-free individual industrial and commercial households who voluntarily participate in social insurance, part-time employees who do not participate in social insurance in the employing unit and other flexible employees shall apply to the social insurance agency for social insurance registration. The state establishes a national unified personal social security number. Personal social security number is a citizen's identity number.
