Article 39 of the Regulations on Work-Related Injury Insurance An employee dies at work, and his next of kin receives from the Work-Related Injury Insurance Fund a funeral grant, a dependent relative's pension, and a one-time benefit for the death of the employee, in accordance with the following regulations:

An employee who died at work receives a funeral grant, a dependent relative's pension, and a one-time benefit for the death at work in accordance with the following regulations: (1) The funeral grant is six months of the employee's average monthly salary for the year preceding the year of the coordinating area. (b) The dependent relatives' pension is paid as a percentage of the employee's own salary to relatives who were unable to work and who provided the main source of livelihood for the employee who died at work. The standard is 40% per month for spouses, 30% per month for each of the other relatives, and 10% per month for each of the widows, orphans or orphans on top of the above standard. The sum of the approved pensions for each dependent relative shall not be higher than the salary of the employee who died at work before his or her death. The specific scope of the dependent relatives shall be stipulated by the social insurance administrative department of the State Council; (c) The standard of the one-time benefit for work-related deaths shall be 20 times the per capita disposable income of urban residents nationwide in the preceding year. If a disabled employee dies as a result of a work-related injury during the period in which he or she is off work without pay, his or her close relatives shall be entitled to the treatment provided for in the first paragraph of this Article. If a Grade 1 to Grade 4 disabled employee dies after the expiration of the period without pay, his or her next of kin may enjoy the treatment provided for in paragraph 1 (a) and (b) of this Article.
