Social security is managed by the administrative department of social insurance in the State Council. The specific contents are as follows:

1. Other relevant departments in the State Council are responsible for relevant social insurance work within their respective responsibilities. The social insurance administrative department of the local people's government at or above the county level is responsible for the social insurance management within its administrative area, and other relevant departments of the local people's government at or above the county level are responsible for the relevant social insurance work within their respective functions and duties;

In China, the administrative department of social insurance in the State Council is Ministry of Human Resources and Social Security, whose main function is to formulate relevant social insurance laws and policies and establish and manage a social insurance system covering urban and rural areas. The social insurance administrative department of the local people's government at or above the county level shall be responsible for the social insurance management in this administrative region. The social insurance plan is organized by the government, forcing a certain group to use part of its income as social insurance tax (fee) to form a social insurance fund. Under certain conditions, the insured can get fixed income or loss compensation from the fund. Employers and individuals in People's Republic of China (PRC) pay social insurance premiums according to law, and have the right to inquire about payment records and personal rights records, and require social insurance agencies to provide social insurance consultation and other related services.

Individuals enjoy social insurance benefits according to law and have the right to supervise the payment of their own units.

Article 10

Employees shall participate in the basic old-age insurance, and the employer and employees shall jointly pay the basic old-age insurance premium.

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic old-age insurance in the employer and other flexible employees can participate in the basic old-age insurance, and individuals pay the basic old-age insurance premium.

The measures for the endowment insurance of civil servants and staff managed by reference to the Civil Service Law shall be formulated by the State Council.
