Legal Basis: Article 54 of the Law of the People's Republic of China on Social Insurance Article 54: If an employer has already paid the maternity insurance premiums, his/her employees shall be entitled to the treatment of maternity insurance; and the unemployed spouses of the employees shall enjoy the treatment of maternity medical expenses in accordance with the provisions of the State. Spouses of employees who are not employed shall enjoy maternity insurance benefits in accordance with State regulations. The necessary funds shall be paid from the Maternity Insurance Fund.
