Legal analysis: active military personnel enjoy the stipulated military insurance treatment, retired military personnel in accordance with the relevant provisions of the state to continue the pension, medical care, unemployment and other social insurance relations, enjoy the corresponding social insurance treatment. Active military personnel enjoy the prescribed vacation, convalescence, medical care, housing and other welfare benefits. The State raises the welfare benefits of active-duty military personnel in accordance with the level of economic and social development. During the period of active service, military personnel are entitled to the prescribed military insurance benefits. Upon their withdrawal from active service, military personnel shall, in accordance with the relevant provisions of the State, continue their social insurance relations in respect of old-age pension, medical care and unemployment, and enjoy the corresponding social insurance benefits. Spouses of active-duty military personnel who are not employed with the military shall enjoy the corresponding security treatment in accordance with the relevant provisions of the State.

Legal basis: The Military Service Law of the People's Republic of China Article 53 The State guarantees that active-duty military personnel shall enjoy treatment appropriate to the performance of their duties. The treatment of active-duty military personnel shall be harmonized with the development of the national economy and be commensurate with social progress. Officers shall be subject to a rank-and-file pay system, non-commissioned officers to a rank-and-file pay system, and conscripts to a supply system of living. Active-duty military personnel are entitled to stipulated allowances, subsidies and incentive pay. The State establishes a mechanism for normal increases in the wages of military personnel. Active-duty military personnel are entitled to welfare benefits such as vacations, convalescence, medical care and housing.
