Do you have to pay social security for labor dispatch?

Labor dispatch units need to pay social insurance for dispatched employees.

According to the Labor Contract Law and relevant laws and regulations, when signing a labor dispatch agreement with the employing unit, the labor dispatch unit shall clearly stipulate the dispatched post, the number of personnel, the dispatch period, the amount of labor remuneration and social insurance premium and the payment method. Dispatching units are obliged to pay social insurance for dispatched employees, including endowment insurance, medical insurance and unemployment insurance. Usually, the dispatching unit is responsible for handling social security registration and payment procedures, and the social security expenses of dispatched employees can be withheld and remitted by the dispatching unit.

The labor dispatch agency will handle social insurance projects according to the salary base of the dispatched employees proposed by the employing unit, and the specific contents are as follows:

Article 18

Where a labor dispatch unit dispatches workers across regions, it shall participate in social insurance for the dispatched workers in the place where the employing unit is located, pay social insurance premiums in accordance with the regulations of the place where the employing unit is located, and the dispatched workers shall enjoy social insurance benefits in accordance with state regulations.

The employing unit shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for its employees. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay.
