What is social insurance premium?
Social insurance funds mainly include five categories, namely: basic old-age insurance funds, basic medical insurance funds, industrial injury insurance funds, unemployment insurance funds and maternity insurance funds. All social insurance funds shall be accounted for according to the types of social insurance, and a unified national accounting system shall be implemented. Social insurance funds shall be earmarked for special purposes, and no organization or individual may occupy or misappropriate them in any form.
The sources of social insurance funds in China can be roughly divided into the following four aspects:
1, the insurance premium paid by the insured according to a certain proportion of his salary income (if the salary income cannot be determined according to the average salary of employees);
2. The insurance premium paid by the insured unit according to a certain proportion of the total wages of the employees of the unit;
3, the government's financial subsidies to social insurance funds;
4. Bank interest or return on investment from social insurance funds and social donations.
The five characteristics of social insurance are as follows:
1. The objective basis of social insurance is the risks existing in the labor field, and the object of insurance is the individual workers;
2. The subject of social insurance is specific. Including workers (including their relatives) and employers;
3. Social insurance is compulsory;
4. The purpose of social insurance is to maintain the reproduction of labor force;
The insurance fund comes from the contributions and financial support of employers and workers. Insurance coverage is limited to employees, excluding other social members. The insurance coverage is limited to all kinds of risks in labor risks, excluding other risks such as property and economy.
Legal basis:
"Regulations for the Implementation of the Enterprise Income Tax Law" Article 35 The basic social insurance premiums and housing accumulation funds paid by enterprises for their employees in accordance with the scope and standards stipulated by the relevant competent departments of the State Council or the provincial people's government are allowed to be deducted. Supplementary endowment insurance premiums and supplementary medical insurance premiums paid by enterprises for investors or employees are allowed to be deducted within the scope and standards stipulated by the competent departments of finance and taxation of the State Council.
Article 84 of the Social Insurance Law of People's Republic of China (PRC), if the employer fails to register for social insurance, the social insurance administrative department shall order it to make corrections within a time limit; If no correction is made within the time limit, the employer shall be fined between one and three times the amount of social insurance premiums payable, and the directly responsible person in charge and other directly responsible personnel shall be fined between 500 yuan and 3,000 yuan.
