Measures of Shaanxi Province for Implementing the Law of People's Republic of China (PRC) on Animal Epidemic Prevention
Quarantine of entry and exit animals and animal products shall be handled in accordance with the Law of People's Republic of China (PRC) on Entry and Exit Animal and Plant Quarantine.
Hygienic inspection and supervision of animals and animal products that have passed the quarantine inspection as food shall be handled in accordance with the provisions of the Food Hygiene Law of People's Republic of China (PRC). Article 3 The people's governments at or above the county level shall strengthen their leadership in animal epidemic prevention, establish a mechanism for monitoring, early warning and rapid extermination of major animal epidemics, improve the animal epidemic prevention and quarantine system, strengthen the construction of animal epidemic-free areas, and make good reserves of epidemic prevention materials.
The provincial people's government shall formulate emergency plans for major animal diseases. City, county (District) people's government shall, according to the emergency plan for major animal diseases formulated by the provincial people's government, formulate emergency plans for major animal diseases in combination with local conditions.
The people's governments at or above the county level shall include the funds for the prevention, control and extermination of animal epidemics in the fiscal budget at the corresponding level. Article 4 The animal husbandry and veterinary administrative department of the provincial people's government is in charge of animal epidemic prevention in the whole province.
City and county (District) people's government animal husbandry and veterinary administrative departments in charge of animal epidemic prevention work within their respective administrative areas. Fifth supervising agencies for animal epidemic prevention at or above the county level shall carry out animal epidemic prevention and animal epidemic prevention supervision within their respective administrative areas according to law.
The supervising agencies for animal epidemic prevention at the county level may dispatch grass-roots supervising agencies for animal quarantine and epidemic prevention, or send animal quarantine officers and supervising personnel for animal epidemic prevention to townships (towns) to carry out animal quarantine and supervising animal epidemic prevention. Chapter II Prevention of Animal Diseases Article 6 The animal husbandry and veterinary administrative department at or above the county level shall formulate an implementation plan according to the national animal disease prevention plan and submit it to the people's government at the same level for approval before implementation.
The planned immunization system and compulsory immunization shall be implemented for animal epidemics that seriously endanger human health and aquaculture production. The management of animal epidemics and immunized animals with compulsory immunization shall be carried out in accordance with the relevant provisions of the state.
Prevention of animal diseases other than compulsory immunization shall be formulated by the animal husbandry and veterinary administrative department at or above the county level, implemented after approval by the people's government at the same level, and reported to the animal husbandry and veterinary administrative department at the next higher level for the record. Article 7 The compulsory immunization of animals shall be subject to the immune labeling system.
After compulsory immunization of animals, grass-roots animal epidemic prevention organizations shall establish immunization files for pigs, cattle and sheep and wear immunization ear tags. Article 8 People's governments at or above the county level shall reserve medicines, biological products and related materials needed for the prevention and extermination of animal epidemics, and bring them into the national economic and social development plan.
Immune ear tags and epidemic (bacterial) vaccines required for compulsory immunization are supplied step by step by the provincial supervising agencies for animal epidemic prevention. No unit or individual may operate.
The vaccines required for compulsory immunization are provided by the government free of charge. The immunization fee shall be borne by the parties concerned, and the charging standard shall be implemented in accordance with the relevant provisions of the state. Article 9 Vehicles, ships and planes transporting animals shall not carry feed, drinking water or other articles that may spread animal diseases in epidemic areas. Article 10 Anyone who needs to preserve, use, introduce or transport animal-borne pathogenic microorganisms or transport animal disease materials due to special needs such as scientific research, teaching and epidemic prevention shall abide by the management system and operating rules stipulated by the state and file with the provincial animal husbandry and veterinary administrative department. Chapter III Control and Extinction of Animal Epidemic Disease Article 11 The supervising agencies for animal epidemic prevention at or above the county level shall be responsible for the reporting of animal epidemic situation, and establish and improve the reporting system of animal epidemic situation step by step in accordance with the relevant provisions of the state.
The provincial animal husbandry and veterinary administrative department shall, under the authorization of the animal husbandry and veterinary administrative department of the State Council, announce the animal epidemic situation within the administrative area of this province. Twelfth major animal epidemic, the people's governments at or above the county level shall, according to the needs, start the emergency plan, organize and coordinate the relevant departments to control and extinguish the epidemic in a timely manner. Article 13 When a class I, class II or class III animal epidemic occurs, the local animal husbandry and veterinary administrative department shall promptly report to the people's government at the corresponding level and decide to block the epidemic area according to law. If the epidemic area involves more than two administrative regions, the people's government at the next higher level in the relevant administrative region shall decide to block the epidemic area, or the people's government at the next higher level in the relevant administrative region shall decide to block the epidemic area.
If the epidemic area is blocked, a blockade order shall be issued. The blockade order includes the geographical scope, time, objects and measures of the blockade. Fourteenth people's government issued a blockade order shall immediately organize relevant departments and units to take the following measures:
(a) set up warning signs around the epidemic area;
(2) culling, destroying or otherwise harmlessly treating animals infected, suspected of being infected or dying in the epidemic area;
(3) Harmless treatment of animal feeding utensils, pens (stables), activity places, vehicles, animal feed, bedding, excreta and other contaminated items in epidemic areas;
(4) Isolating animals suspected of being infected with epidemic diseases and classifying them according to the types of animal diseases after diagnosis;
(5) It is forbidden to transport animals and animal products that are susceptible to infection into or out of the epidemic area, set up temporary epidemic prevention and disinfection stations on the main roads entering and leaving the epidemic area, and disinfect personnel, vehicles and related articles entering and leaving the epidemic area according to the needs of fighting animal epidemics;
(6) Stop the trade of animals and animal products related to the epidemic in the epidemic area.
