The company has recruited people over retirement age. How to sign a contract or pay insurance?

For those who exceed the retirement age, their re-employment belongs to labor relations, and they can only sign employment agreements with enterprises in the nature of labor contracts. The legal rights and obligations with the enterprise are determined by the employment agreement, general principles of civil law, contract law and other civil legal norms of China. Article 13 of China's "Notice on Several Issues Concerning the Implementation of the Labor Contract System" stipulates that when retirees who have already enjoyed the pension insurance benefits are re-employed, the employer shall sign a written agreement with them to clarify the rights and obligations such as work content, labor remuneration, medical care and labor insurance benefits during employment.

People who are over the retirement age also mean that they are over the age of insurance, so even if they are re-employed, there is no factor to pay social security. Therefore, for those who have already enjoyed the old-age insurance benefits or pensions, if they get sick during the re-employment, what responsibilities the unit will bear depends on the agreement of both parties in the contract.
