Measures of Kunming Municipality on the Administration of Automobile Maintenance Industry

Chapter I General Provisions Article 1 In order to strengthen the management of automobile maintenance industry in our city, ensure traffic safety and protect the legitimate rights and interests of automobile maintenance operators and users, these measures are formulated in accordance with the spirit of the Interim Measures for the Administration of Automobile Maintenance Industry issued by the Ministry of Communications, the State Economic Commission and the State Administration for Industry and Commerce. Article 2 All enterprises owned by the whole people, collective ownership, joint venture ownership, individual ownership, joint venture ownership and foreign-funded enterprise ownership engaged in the maintenance and special repair of commercial vehicles (including trailers, semi-trailers, special vehicles, non-agricultural tractors and motorcycles) within the administrative area of this Municipality, special maintenance service stations set up by automobile production enterprises in Kunming, and self-provided maintenance departments contracted by government agencies, enterprises, institutions and troops (hereinafter referred to as automobile maintenance operators). Article 3 Kunming Municipal Bureau of Transportation is the competent department of automobile maintenance industry in our city, and has set up corresponding management institutions to be responsible for the centralized management of automobile maintenance industry in our city. County Transportation (Gongjiao) Bureau is the management department of the automobile maintenance industry in the county and district, and accepts the guidance of Kunming Municipal Transportation Bureau in business.

Automobile maintenance operators shall abide by these measures and obey the management, guidance and supervision of industry management departments. Chapter II Responsibilities of the Competent Department of Automobile Maintenance Industry Article 4 Implement national, provincial and municipal automobile maintenance industry policies, formulate industry development plans, standards and management measures, and coordinate the layout of maintenance outlets. Fifth regular or irregular organization industry quality supervision, inspection, appraisal and commendation; Responsible for organizing the popularization and application of new technologies, new processes and new standards; Carry out technical consultation, exchange information, and do a good job in technical cooperation of automobile maintenance machinery and equipment and maintenance parts. Article 6 Actively organize professional and technical training for employees in the maintenance industry, and be responsible for the assessment of the technical level of employees, the issuance of relevant certificates and the moral education of employees. Seventh to undertake the examination of the opening, closure, change and technical level change of the automobile maintenance industry; Making automobile maintenance technical certificate and overhaul certificate; Supervise the maintenance operators to implement the charging standards for automobile maintenance and the use and management of unified special bills for automobile maintenance. Eighth to strengthen the management of the industry, and actively promote the horizontal joint and professional cooperation of the industry, and promote the coordinated development of various automobile maintenance industries. Chapter III Opening and Closing of Business Article 9 An entity applying for automobile maintenance business shall submit an application for opening business to the local competent department of industry with the approval document of the competent department and the certificate of the neighborhood office or the township people's government where the individual business households are registered. After examination and approval, the technical level shall be determined. Only after the competent department of the industry issues the Application Form for Examination of Opening Technical Conditions, the Technical Certificate of Automobile Maintenance Industry and relevant approval certificates can it start business. Article 10 An automobile maintenance operator applying for business opening must meet the following conditions:

1. Having business premises (land), workshops, parking lots, special machines and tools, equipment and funds suitable for the business category;

2, there are engineering and technical personnel, skilled workers and management personnel to adapt to the business category;

3. Having quality inspection equipment, inspection system and quality inspectors suitable for the business category. Eleventh automobile maintenance business level, mainly divided into the following three categories:

1, automobile overhaul, assembly repair;

2. Automobile maintenance (advanced maintenance, low-level maintenance);

3. Special car repair (refers to car body repair, painting, replacement of car doors and windows, repair of electrical equipment, batteries, tarpaulin mats, water tanks, tires and air conditioners). Article 12 It is forbidden to transfer, sublet, alter or forge the Technical Certificate of Automobile Maintenance Industry and the Business License. Article 13 When applying for suspension of business, an automobile maintenance operator shall apply to the local industry authorities one month ago, be responsible for clearing the creditor's rights and debts, go through the cancellation procedures of the Business License at the administrative department for industry and commerce, and cancel the bank account. Chapter IV Technical Quality Management of Automobile Maintenance Article 14 The management organization of automobile maintenance industry of Kunming Municipal Bureau of Transportation shall be responsible for inspecting and supervising the quality of automobile maintenance, and set up an automobile maintenance technical quality supervision and testing center to be responsible for specific work.

The functions of the testing center are: to supervise and inspect the implementation of automobile repair technical standards, factory inspection certificates and other related quality standards; Responsible for the quality inspection guidance and quality accident analysis of automobile maintenance operators; At the request of users, we will provide paid service for automobile maintenance quality inspection.

If the monitoring conditions are not available, the supervision and testing center may entrust the monitoring project to a qualified department for monitoring. Article 15 Automobile maintenance must implement the technical standards for automobile repair issued by the State Bureau of Standards and Metrology (GB 3798-3803-83) and GB 5336-85, and the technical standards for automobile repair issued by the Ministry of Communications (JT-31-8/KLOC-0), or the local authorities in charge of transportation at the provincial and municipal levels shall formulate according to the above standards. The maintenance standards of urban public transport vehicles shall be implemented in accordance with the provisions of the Ministry of Construction. The maintenance quality of all kinds of vehicles should meet the safety inspection standards of vehicle management departments. Sixteenth car maintenance operators must adhere to the reputation first, users first, quality first. For vehicles undergoing vehicle overhaul and assembly repair, all technical files, factory certificates and other technical documents shall be provided when leaving the factory, and a certain warranty period shall be stipulated. For quality disputes caused by the quality of automobile maintenance, the responsible party shall bear the required monitoring expenses.
