Chapter 2 of Linyi City’s Interim Measures for Urban Property Management Owners Meeting and Owners Committee

Article 6 If any of the following circumstances occurs, the property management department shall, together with the construction unit, organize the first owners’ meeting to elect an owners committee:

(1) Publicly owned housing The sales rate reaches more than 30%;

(2) The occupancy rate of residential areas (including residential areas) reaches more than 50%.

Article 7 The owners' committee shall be elected by the owners' meeting, and the members of the owners' committee shall be the owners.

Article 8 The owners’ meeting shall be composed of all owners.

Resolutions made by the owners' meeting must be passed by more than half of all owners.

The owners' committee shall convene an owners' meeting at least once a year; upon the proposal of more than 15% of the owners, the owners' committee shall convene an owners' meeting on the proposed topic.

Article 9 The owners committee is an organization that represents all owners in the property management area and implements autonomous management of the property.

The director, deputy directors and members of the owners' committee are elected by the owners' meeting among all owners.

The owners committee consists of five to fifteen people depending on the size of the property.

The term of each owner committee is two years.

Article 10 The owners' committee shall perform the following duties under the supervision and guidance of the owners' conference:

(1) Convene and preside over the owners' conference and report on the implementation of property management;

(2) Select a property management company through public bidding, and enter into, change or terminate a property management contract with the property management company;

(3) Supervise public facilities, equipment and public venues Use;

(4) Examine and approve the property management plan proposed by the property management company;

(5) Listen to the opinions and suggestions of the owners and supervise the work of the property management company;

(6) Other responsibilities assigned by the owners' meeting.

Article 11 The owners committee shall hold regular meetings, and its decisions must be approved by more than half of all members to be effective.

When the owners' committee holds a meeting, it should invite relevant government departments and sub-district offices, public security police stations, residents' committees, property management companies and other units to participate.

Article 12 The owners' covenant is a code of conduct regarding property use, maintenance and management service activities, and is binding on all owners and non-owners.

The owners' covenant shall be effective from the date of review and approval by the owners' meeting.

Article 13 Before the owners’ agreement comes into effect, owners and non-owners shall abide by the management regulations formulated by the development and construction unit.
