Article 1 In order to improve the technical and professional quality of production safety of mine managers of mining enterprises and strengthen mine safety production management, in accordance with the "Mining Safety Law of the People's Republic of China" and "Hunan Province Implementation of the People's Republic of China ***Measures of the Mining Safety Law of the People's Republic of China and other relevant national regulations, and based on the actual situation of our province, these measures are formulated. Article 2 These Measures apply to the main operations of state, city, and county mining enterprises, township and village collective mining enterprises, mine directors and deputy mine directors in charge of safety, technology, and production in our province, as well as private mining enterprises and individual partnership mining organizations. managers and managers (hereinafter collectively referred to as mine managers).

The safety technical business qualification review of mine directors of ministries and provincial mining enterprises shall be carried out in accordance with relevant national regulations. The safety technology business qualification examination methods for heads of individual mining households shall be formulated by the county and municipal people's governments. Article 3 Anyone who serves as a mine director must, in accordance with the provisions of these Measures, participate in the mine director's safety technical business qualification review (hereinafter referred to as the mine director's qualification review) and obtain the mine director's safety technical business qualification certificate; otherwise, he may not serve as a mine manager or contract , leasing mining enterprises.

People's governments at all levels and their personnel departments, mining enterprise industry authorities and village committees and village groups shall not appoint, recruit or approve people who have not obtained the mine manager's safety technical business qualification certificate to serve as mine directors. Article 4 For a newly established mining enterprise, the candidate for the mine manager must first obtain the mine manager safety technical business qualification certificate. Otherwise, the competent industry department shall not approve the establishment, and the competent department of geology and mineral resources shall not issue a mining license. Article 5 Anyone who applies for and is recommended to participate in the mine director qualification review must meet the following basic conditions:

(1) Can implement national guidelines and policies on production safety and mine safety and mineral resource management Laws and regulations;

(2) Be familiar with the safety and health requirements of each production system of the mining enterprise, and understand the performance and usage conditions of the main production equipment and safety facilities of the mining enterprise;

(3) Have the ability to lead safe production and prevent and handle mining disasters;

(4) Mine directors of mining enterprises at or above the county level must have an education level equivalent to technical secondary school or above or obtain engineering series technology above junior level Position; mine directors of township and town mining enterprises must have a high school education or above; mine directors of village-run mining enterprises, private mining enterprises and individual partnership mining organizations must have a junior high school education or above;

( 5) Have more than 2 years of mining work experience;

(6) Be in good health and be able to persist in going deep into the underground production site;

(7) Other employment conditions stipulated by relevant departments. Article 6 The qualification review of the mine manager shall be conducted according to the following procedures:

(1) Application. To participate in the qualification review of mine managers of mining enterprises at or above the county level, the enterprise administration shall report to the industry supervisor Department declaration.

(2) Review training. After receiving the application report, the industry competent department shall, together with the mine safety competent department at the same level, conduct an examination in accordance with the conditions stipulated in Article 5 of these Measures. After passing the review, the industry authorities will conduct safety technical business training together with the mine safety authorities at the same level. Personnel who have graduated from a technical secondary school or above with a mining major may be exempted from training with the approval of the mine safety department.

(3) Examination and assessment. For those who are trained or self-study, the mining safety authorities at or above the state or city level, together with the industry authorities, will conduct theoretical examinations and practical assessments in accordance with the examination syllabus and training materials. The examination syllabus and training materials shall be formulated, compiled or selected by the Provincial Department of Labor in conjunction with relevant industry authorities.

(4) Issuance of certificates.

Those who pass the review, examination and assessment will be issued the "Hunan Provincial Mine Director Safety Technical Business Qualification Certificate" (hereinafter referred to as the Mine Director Qualification Certificate) by the mine safety administrative department at or above the state or city level, and the personnel department and industry where the enterprise is located will be notified. competent authorities and township people's governments. Article 7 The mine manager qualification certificate only proves that the holder is qualified to hold the position of mine manager in terms of safety technical and professional qualities. Whether or not to hold a position shall be appointed, recruited or approved in accordance with relevant regulations. If you do not serve as a mine manager for three years after obtaining the mine manager qualification certificate, the mine manager qualification certificate will automatically expire; if you serve as a mine manager after three years, you can be exempted from training and directly participate in examinations and assessments. Article 8 If a holder of a mine director qualification certificate moves to serve as a mine director of the same type of mining enterprise, the mine director qualification certificate is valid; if he serves as a mine director of a different type of mining enterprise, he must re-obtain a mine director qualification certificate that meets the requirements of the mining enterprise. Article 9 The mine safety authorities, industry authorities, and township people's governments shall supervise and inspect the mine director's implementation of national safety production guidelines, policies, laws, regulations, and enterprise safety production conditions during his term of office. If the mine director is found to have failed to perform his safety production management duties, If a person's behavior is serious or he is dismissed or criminally punished due to an accident, the mine safety department shall revoke his "Mine Manager Qualification Certificate". Article 10 Anyone who violates the provisions of Article 3 of these Measures and serves as a mine manager without obtaining a mine manager qualification certificate shall be ordered by the mine safety department to make corrections within a time limit; if corrections are not made within the time limit, the people's government at or above the county level shall be submitted to the people's government at or above the county level for a decision to order the suspension of production and the adjustment of equipment and equipment with qualified mines. After a long time, production can be resumed.
