Decision of the Ministry of Transport on Amending the Rules for Competency Examination and Certification of Inland River Ship Crew in People's Republic of China (PRC) (2020)

First, the "Ministry of Transport of the State Council" in Article 3 is amended as "Ministry of Transport"; The "national maritime administrative agency" in Articles 3, 4, 7, 12 and 17 is amended as "Maritime Bureau of the Ministry of Transport"; Article 24 is changed to Article 28, Article 26 to Article 30, and "State Maritime Safety Administration" is changed to "Maritime Safety Administration of the Ministry of Transport". 2. Paragraph 1 of Article 6 is amended as: "Crew members of inland river vessels shall obtain certificates of competency corresponding to their work requirements, tonnage, main engine power and navigation area (line)." Three. Article 11 is amended as: "To obtain a certificate of competency, the following conditions shall be met:

(a) At least 18 years old (at least 16 years old for internship and training on board), and at least 60 years old when applying for the first time;

(2) meeting the health requirements of the crew position;

(3) Having received basic safety training for seafarers;

(4) Having passed the competency examination for the crew of inland river vessels in the subjects specified by the Maritime Safety Administration of the Ministry of Transport.

The crew members who participate in navigation and engine duty shall also undergo corresponding competency training and special training for crew members, have corresponding crew qualifications (see Annex "Requirements for Water Service Qualification of Inland River Ship Crews"), and have good performance and safety records. 4. The first paragraph of Article 16 is amended as: "The validity period of the certificate of competency for crew members who participate in navigation and engine watch shall not exceed 5 years. The "Certificate of Competency" for crew members who do not participate in navigation and engine duty is valid for a long time. " 5. Article 19 is amended as: "To apply for a certificate of competency, a crew member of an inland river vessel who does not participate in navigation and engine duty shall apply to a license issuing agency with corresponding license issuing authority and submit the following materials:

(1) An application form for the certificate of competency for the crew of inland river vessels;

(2) the identity certificate of the applicant;

(3) Physical examination certificates that meet the health standards for the crew of inland river vessels in the last two years;

(four) photos that meet the requirements of specifications and quantity;

(five) the basic safety training certificate. 6. One article is added as Article 20: "The crew members of inland river vessels who apply for navigation and engine watch shall first obtain the competency certificates as stipulated in Article 19 of these Rules, and submit the following materials to the license issuing agencies with corresponding license issuing authority:

(1) An application form for the certificate of competency for the crew of inland river vessels;

(2) the identity certificate of the applicant;

(3) Physical examination certificates that meet the health standards for the crew of inland river vessels in the last two years;

(four) photos that meet the requirements of specifications and quantity;

(5) Post competency training certificate;

(six) the examination results of the certificate of competency for the crew of inland river ships;

(7) Crew service book;

(8) Current Certificate of Competency. 7. One article is added as Article 21: "Where a crew member of an inland river vessel engaged in navigation and engine duty applies for changing the categories and job qualifications listed in the certificate of competency, he shall submit the materials specified in Article 20 of these Rules to a license issuing agency with corresponding license issuing authority.

The crew members of inland river ships who are on duty for navigation and engineering shall apply for expanding or extending the navigation area (line), and shall submit the materials specified in Items (1), (2), (6) and (8) of Article 20 of these Detailed Rules to the license issuing agency responsible for issuing the corresponding navigation area (line). One article is added as Article 22: "Anyone who applies for a certificate of competency in accordance with the provisions of Article 12 shall submit the materials specified in Items (1), (2), (3), (4) and (6) of Article 20 of these Detailed Rules and the corresponding qualification certificate to a license issuing agency with corresponding license issuing authority." One article is added as Article 23: "The maritime administrative agency shall issue corresponding certificates of competency in accordance with the requirements of the Administrative Licensing Law and the Provisions on Procedures for the Implementation of Traffic Administrative Licensing.

The maritime administrative agency shall issue a service book for seafarers who apply for a certificate of competency for the first time. 10. Article 20 is changed into Article 24 and amended as: "To apply for the renewal of the certificate of competency, the materials specified in Items (1), (2), (3), (4), (7) and (8) of Article 20 shall be submitted; If it is necessary to pass the competency examination for the crew of inland river ships, the corresponding examination results shall also be submitted. " Eleven, twenty-seventh to thirty-first, delete the third paragraph. One paragraph is added as the second paragraph: "A seafarer's Service Book shall also be submitted when applying for taking the seafarer's competency examination for navigation and engine watch." Twelve, thirty-second to thirty-sixth, the second paragraph of the "holding the crew service book" is amended as "holding the" certificate of competency "and" crew service book "not to participate in navigation and maritime duty".

The serial number of articles and individual words shall be adjusted accordingly.

This decision shall come into force as of the date of promulgation.
