Article 1 In order to strengthen the safety and construction management of flood storage and detention areas in this Municipality, give full play to the functions of flood storage and detention areas, reduce the inundation loss of flood diversion and detention water, and ensure the safety of economic construction and people's lives and property, these Regulations are formulated in accordance with the People's Republic of China (PRC) Water Law and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The flood storage and detention areas mentioned in these Regulations refer to thirteen low-lying areas for temporary flood storage and regulation within the administrative area of this Municipality, such as Qingdianwa, Shengzhuangwa, Huang Zhuang Wa, Dahuangbao Wa, Yongding River Beach, Triangle Lake, Qilihai, Dongdian, Wen Zi Wa, Jiakouwa, Tuanbowa, Dagang Spillway and Dianbei.

These Regulations shall apply to the operation, safety and construction management of flood storage and detention areas specified in the preceding paragraph. Article 3 Flood storage and detention in flood storage and detention areas shall be implemented in accordance with the flood diversion and detention scheme approved by the state flood control headquarters. Changes in the safety construction planning of flood storage and detention areas must be approved by the Municipal People's Government. To formulate plans for economic construction and social development in flood storage and detention areas, the opinions of the municipal water administrative department shall be sought. Article 8 Land use, development and various constructions in flood storage and detention areas must meet the requirements of flood control. In the vicinity of designated flood diversion gates and flood mainstream areas, it is forbidden to build all kinds of buildings that hinder flood discharge. Article 9 When new permanent buildings are built in flood storage and detention areas, they should avoid the flood flow path, choose a place with higher terrain and adopt a flat roof structure to avoid floods and save lives.

When building, rebuilding or expanding construction projects in flood storage and detention areas, the construction unit shall go through the examination and approval procedures in accordance with the basic construction procedures after being examined and approved by the water administrative department in accordance with the relevant provisions of the state.

If the existing buildings in flood storage and detention areas do not meet the flood control standards, they should be reinforced or other remedial measures should be taken. Tenth flood storage and detention areas are strictly prohibited to build, rebuild or expand construction projects that produce or store toxic, explosive and other serious pollutants and dangerous goods to avoid secondary disasters.

Existing facilities for producing or storing toxic, explosive and other serious pollutants and dangerous goods in flood storage and detention areas must move out of flood storage and detention areas or change production within three years from the date of implementation of these regulations, and must take safety measures themselves before moving out.

Before the implementation of these regulations, the construction of the project prohibited by the first paragraph of this article has been approved. If the construction is not completed, the construction shall be stopped; If it has not yet started, it shall not start construction. Article 11 People's governments at all levels shall strictly control the population growth in flood storage and detention areas and restrict the resettlement of migrants in flood storage and detention areas. Article 12 The people's governments of districts and counties where flood storage and detention areas are located shall organize water administrative departments to formulate plans for the safe transfer of residents in flood storage and detention areas.

Safety buildings and other permanent buildings should be marked with the highest flood level line in local history. Article 13 The people's governments of districts and counties where flood storage and detention areas are located shall, according to the needs of flood avoidance and evacuation, combine urban and rural construction, build roads in a planned way, delineate evacuation routes for residents, and implement temporary resettlement sites for residents. Fourteenth flood storage and detention areas should be equipped with two sets of communication systems: wired communication and special wireless communication. Cable communication construction should be included in the urban and rural telecommunication network construction plan, giving priority to implementation; The construction of special wireless communication for flood control shall be organized and implemented by flood control institutions at all levels. Flood control alarm facilities can be set up according to local conditions and people's habits, and the alarm mode can be made public to ensure timely and effective alarm.

Flood control communication must be smooth, and no unit or individual may interfere. Fifteenth it is forbidden to damage dikes and diversion dikes in flood storage and detention areas. Without the approval of the district and county water administrative departments, the original highlands and old dikes in flood storage and detention areas shall not be demolished.
