Measures of Chongqing Municipality on Implementing the Regulations on Resettlement for the Construction of Three Gorges Project (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to do a good job in the resettlement work in Chongqing Reservoir Area of the Three Gorges Project, safeguard the legitimate rights and interests of the migrants, ensure the smooth construction of the Three Gorges Project and promote the economic and social development of the Three Gorges Reservoir Area, these measures are formulated in accordance with the Regulations on Resettlement in the Construction of the Three Gorges Project and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the migrants for the construction of the Three Gorges Project within the administrative area of this Municipality. Article 3 The Municipal People's Government shall be responsible for the resettlement of the Three Gorges Project within the administrative area of this Municipality. The people's governments of counties (autonomous counties) shall be responsible for the resettlement work of the Three Gorges Project within their respective jurisdictions.

City, county (Autonomous County) people's government immigration administrative departments responsible for the comprehensive management of immigrants within their respective jurisdictions.

The relevant administrative departments of the people's governments of cities and counties (autonomous counties) shall, in accordance with the division of responsibilities, conscientiously do a good job in immigration management.

Township (town) people's governments and sub-district offices shall undertake the immigration management entrusted by the people's governments of counties (autonomous counties) and their administrative departments. Article 4 Resettlement units and immigrants shall enjoy the right to compensation according to law and undertake the obligation of relocation. Article 5 The people's governments of cities, districts and counties (autonomous counties) shall adhere to the sustainable development strategy and strengthen soil and water conservation, environmental protection and ecological environment construction in the reservoir area according to the environmental protection construction plan of the reservoir area and the development plan of the ecological economic zone in the Three Gorges reservoir area of this Municipality. Chapter II Resettlement Article 7 The people's governments of districts and counties (autonomous counties) shall, according to the outline of reservoir inundation treatment and resettlement planning of the Three Gorges Project of the Yangtze River and the resettlement planning of the whole city, prepare the resettlement plan of their own regions, and report it to the Municipal People's Government for examination and approval, and prepare the resettlement implementation plan and household resettlement plan according to the approved resettlement plan.

The Municipal People's Government and its immigration administrative departments shall strengthen supervision over the implementation of the resettlement plan. Eighth rural migrants should first be resettled in districts and counties (autonomous counties). Counties (autonomous counties) that cannot be resettled shall be resettled by the Municipal People's Government in other counties (autonomous counties) within the administrative area of this Municipality, or in other provinces, autonomous regions and municipalities directly under the Central Government according to national planning.

Rural resettlement shall be organized and implemented by the people's governments of counties (autonomous counties), and shall be implemented in accordance with the resettlement plan and annual plan. Article 9 Where rural immigrants are resettled in the form of agricultural production within the administrative area of this Municipality, the people's governments of resettlement districts and counties (autonomous counties) shall take measures such as adjustment, development and transformation to arrange a piece of cultivated land not lower than the per capita standard of resettlement areas for each rural immigrant.

Resettlement in the suburbs, the per capita arable land is less than 0.033 hectares (0.5 mu), upon the written application of the immigrant himself, with the approval of the township (town) people's government or the subdistrict office, can implement work-study resettlement. Article 10 Where rural migrants are resettled in counties (autonomous counties), the rural collective economic organization in the resettlement area shall sign a resettlement agreement with the immigration management department of the county (autonomous county) or the township (town) people's government or subdistrict office entrusted by it, and the people's government of the county (autonomous county) shall verify it.

Rural migrants who are resettled in other counties (autonomous counties) within the administrative area of this Municipality shall sign an agreement with the people's government of the county (autonomous county) where they move out.

Where rural migrants are resettled outside the administrative area of this Municipality, the municipal people's government and the provincial people's government of the resettlement place shall sign an agreement in accordance with the relevant provisions of the state. Eleventh secondary and tertiary industries to resettle rural immigrants, immigrants themselves should apply to the township (town) people's government and street offices.

After the township (town) people's government and the subdistrict office have been audited and reported to the county (autonomous county) immigration management department, the production resettlement fee will be sent to the immigrant himself, and the immigrant himself and the receiving unit will sign a resettlement employment contract. Units receiving immigrants shall handle unemployment insurance and endowment insurance for migrant workers. Article 12 Rural migrants who have the conditions to engage in self-employment may seek self-employment upon their own application, with the consent of the village or group, with the approval of the people's government of a township (town) or the subdistrict office, and with the approval of the immigration management department of a county (autonomous county). Thirteenth due to the relocation of the Three Gorges Project, rural migrants whose land has been requisitioned and resettled in the secondary and tertiary industries or engaged in self-employment may be transferred to non-agricultural registered permanent residence upon their written application and approval by the people's governments of relevant districts and counties (autonomous counties). The local public security organ shall go through the relevant formalities according to law. Fourteenth rural immigrants who move out to resettle their relatives and friends, the people's government of the receiving township (town) or the sub-district office shall sign a resettlement agreement with the immigrants themselves and issue a certificate of acceptance; The public security organ of the county (autonomous county) of the receiving place shall issue a residence permit; The people's governments of counties (autonomous counties) in the receiving areas shall sign opinions.

Rural migrants who visit relatives and take refuge in friends and move out independently shall apply for resettlement in the place where they move out. With the consent of the people's government of the village, group or township (town) or the subdistrict office, the immigration administrative department of the county (autonomous county) shall examine and approve the application, and the people's government of the county (autonomous county) shall issue a certificate.
