Chapter I General Provisions Article 1 In order to strengthen the management of river courses, ensure the safety of flood control and give full play to the comprehensive benefits of river courses, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Regulations on the Management of River Courses in People's Republic of China (PRC) and relevant laws and regulations of the state, combined with the actual situation of our province. Article 2 These Regulations shall apply to rivers in our province.

The waterway in the river shall also abide by the laws and regulations on waterway management. Article 3 Scope of river course management: Rivers with dikes include waters between dikes on both banks, regulation works, sandbanks, beaches (including cultivated land and forest land), flood discharge areas and dike protection areas designated by people's governments at or above the county level; The river without dike is determined according to the design flood level, and the river without approval of planning and design is determined according to the highest flood level in history. Article 4 The development and utilization of river resources and the prevention and control of water disasters shall be comprehensively planned, given overall consideration, comprehensively utilized, and benefit-oriented, subject to the overall deployment of flood control, and promote the development of various undertakings. Article 5 The water administrative department of the provincial people's government is the competent authority of rivers in the whole province.

The water administrative department of the people's government at or above the county level is the competent authority of the river within its administrative area. Sixth river management to implement the principle of unified management and hierarchical management. Provincial river authorities shall manage the rivers of major rivers in the province; The rivers of other rivers shall be managed by the competent river authorities of cities (prefectures) and counties (cities, districts) according to administrative divisions.

The delineation of major rivers shall be proposed by the provincial river authorities and submitted to the provincial people's government for approval. Seventh river flood control and obstacle clearing work to implement the responsibility system of the chief executive of the people's government. Flood control headquarters at all levels shall be responsible for organizing the implementation of river flood control and obstacle removal.

All units and individuals have the obligation to protect the safety of river dikes and participate in flood control and emergency rescue. Article 8 The competent river authorities and river supervisors of the people's governments at all levels must, in accordance with national laws and regulations, strengthen river protection, strictly implement supervision and management, execute flood control dispatching orders, and ensure the safety of river projects and people's lives and property. Chapter II River Regulation and Construction Article 9 River regulation authorities at all levels shall, in accordance with the comprehensive river basin planning, flood control standards, navigation standards and other relevant technical requirements, and in accordance with the river management authority, formulate river regulation plans, report them to the people's government at the same level for approval, and report them to the river regulation authorities at the next higher level for the record.

When the cities along the Yangtze River are preparing the overall urban construction plan, the professional planning of urban river regulation should be organized by the river authorities on the basis of river basin, flood control and river regulation planning, and be incorporated into the overall urban construction plan after being reported to the superior river authorities for examination and approval. Article 10 The regulation and utilization of river courses and the construction within the scope of river course management shall follow the river course regulation planning, and maintain the stability of river regime and the smooth flow of flood discharge and navigation. Eleventh in the process of river regulation, involving waterway, should take into account the shipping needs, and solicit the opinions of the transportation department on the relevant design and planning in advance.

The traffic department shall comply with the requirements of flood control safety in waterway regulation, and solicit the opinions of the river authorities on relevant design and planning in advance. Twelfth river regulation, dike reinforcement and soil need to occupy land, by the local people's government to solve. The land increased by river regulation belongs to the state and can be used by people's governments at or above the county level for resettlement and river regulation projects. Article 13 The construction of bridges, wharves and other facilities on river courses must be carried out in accordance with the river width determined by the flood control standards stipulated by the state.

The clearance height of pipelines and lines crossing rivers must meet the requirements of flood control. Article 14 In the construction and development of water conservancy, prevention and control of water disasters, regulation of river courses, construction of bridges, docks, roads, ferries, pipelines, cables and other buildings and facilities across the river, the construction unit must report the project construction plan to the river authorities for examination and approval in accordance with the river management authority, and then go through the examination and approval procedures in accordance with the basic construction procedures.

After the approval of the construction project, the construction unit shall inform the river authorities of the construction arrangements. Fifteenth new culverts, pumping stations, buried pipelines, cables and other buildings and facilities on dikes should be used after the completion of the project, and accept the safety management of the river authorities.

Where the buildings and facilities mentioned in the preceding paragraph have been built on dikes, the river authorities shall conduct regular inspections. Do not meet the safety requirements of the project, the original construction unit shall make renovation or maintenance within a time limit. Article 16 If it is really necessary to use the crest or dike as a road, it must be approved by the river authorities. The road surface of this embankment is built and maintained by the traffic or related departments.

In addition to flood control vehicles, vehicles are prohibited from passing through dams with muddy roads and dams without roads.

All kinds of roads across the top of the dike must be filled with approach roads. Article 17 It is forbidden to build drainage, water diversion and water storage projects and river regulation projects in river courses without the agreement of the parties concerned or the approval of the river authorities at higher levels.

The original construction unit shall be responsible for taking remedial measures for drainage, water blocking, water diversion and water storage projects and river regulation projects that cause harm to the other side or upstream and downstream. Unable to take remedial measures, it should be removed within a time limit.
