Vietnam’s foreign investment policies

Legal analysis: China is not a country of immigrants. Generally, foreigners can only obtain one permanent residence. The specific policies are as follows:

Foreigners applying for permanent residence in China should abide by Chinese laws, be in good health, have no criminal record, and meet one of the following conditions: 1:

(1) Direct investment in China, stable investment status for three consecutive years and good tax record;

(2) Served as deputy general manager, deputy factory director, etc. in China or above, or have associate senior professional titles such as associate professor, associate researcher or above, and enjoy equivalent treatment, have served for four consecutive years, have resided in China for no less than three years in total within four years, and have good tax records;

( 3) Those who have made major and outstanding contributions to China and are in special need of the country;

(4) The spouses of the persons mentioned in Items 1, 2 and 3 of this paragraph and their children under the age of 18 Unmarried children;

(5) The spouse of a Chinese citizen or a foreigner who has obtained permanent residence status in China, the marriage has lasted for five years or more, has resided in China continuously for more than five years, and has resided in China for a number of times each year Those who are nine months old and have stable living security and residence;

(6) Unmarried children under the age of 18 seek refuge with their parents;

(7) Those who have no direct relatives abroad and seek refuge with their parents Immediate family members in the country who are over 60 years old, have resided in China continuously for five years, stay in China for no less than nine months each year, and have stable living security and residence.

The years mentioned in this article refer to the consecutive years before the date of application.

Article 6 Foreigners applying for permanent residence in China shall abide by Chinese laws, be in good health, and have no crime records, and meet one of the following conditions: (1) Direct investment in China, stable investment status for three consecutive years, and good tax records; (2) Holding positions such as deputy general manager, deputy factory director or above in China, or having associate professor, deputy directorship, etc. Those who have deputy senior professional titles such as researcher or above and enjoy the same treatment, have served for four consecutive years, have resided in China for no less than three years in total within four years, and have good tax records; (3) Those who have made major and outstanding contributions to China and are in special need of the country ; (4) Spouses of persons referred to in Items 1, 2 and 3 of this paragraph and their unmarried children under the age of 18; (5) Spouses of Chinese citizens or foreigners who have obtained permanent residence status in China, The marriage has lasted for more than five years, has resided in China continuously for five years, stayed in China for no less than nine months each year, and has stable living security and residence; (6) Unmarried children under the age of 18 have joined their parents; (7) ) who have no direct relatives abroad and are seeking refuge with immediate relatives in China, who are over 60 years old, have resided in China for five consecutive years, stay in China for no less than nine months each year, and have stable living security and residence. The number of years mentioned in this article refers to the consecutive number of years before the date of application.

Article 7 For foreigners referred to in Item 1 of Article 6, Paragraph 1 of these Measures, the registered capital actually paid for their investment in China shall meet one of the following conditions: (1) In the country The total investment in industries encouraged by the "Foreign Investment Industry Guidance Catalog" promulgated is more than 500,000 US dollars; (2) The total investment in the western region of China and the key counties for national poverty alleviation and development work is more than 500,000 US dollars; (3) The total investment in central China is 100,000 US dollars More than 10,000 US dollars; (4) The total investment in China is more than 2 million US dollars.

Article 8 For foreigners referred to in Item 2 of Paragraph 1 of Article 6 of these Measures, their employment units shall meet one of the following conditions: (1) Departments under the State Council or provincial people’s governments Institutions; (2) Key universities and colleges; (3) Enterprises and institutions that implement national key engineering projects or major scientific research projects; (4) High-tech enterprises, encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises or foreign-invested product exports enterprise.

Article 9 Applicants must truthfully fill in the "Application Form for Permanent Residence in China for Foreigners" when applying, and submit the following materials: (1) A valid foreign passport or a document that can replace a passport; (2) Health certificate issued by the health and quarantine department designated by the Chinese government or issued by a foreign health and medical institution certified by the Chinese embassy or consulate abroad; (3) Certificate of no criminal record abroad certified by the Chinese embassy or consulate abroad; ( 4) Four recent 2-inch full-face, bareheaded color photos; (5) Other relevant materials as stipulated in these Measures.
