What if the hukou has no homestead in the village?

There is no homestead in the village. The solution is as follows:

1. You can apply for homestead to this collective economic organization. After the collective economic organizations or villagers' groups post no objection, they shall be submitted to the township for examination and approval, and the eligible homestead shall be given after the approval of the county and city.

2. Homestead has the specific function of ensuring farmers' basic housing needs and maintaining rural stability. The right to use the homestead needs to go through a strict examination and approval system, and the right to use the homestead has strict identity restrictions and can only be transferred to members within the collective economic organization.

The right to use the homestead has the following characteristics:

1, the subject of homestead use right is specific, and it is limited to rural residents in principle;

2. The object of the right to use the homestead is specific and limited to the collectively owned land;

3. The content of the right to use the homestead is specific, which is limited to the houses and ancillary facilities built and maintained by individuals according to law;

4. The initial acquisition of the right to use the homestead is free. The right to use homestead is a kind of social welfare right, which is obtained and used by members of collective economic organizations free of charge;

5. There is no time limit for the right to use the homestead. China's current laws have no restrictions on the term of the right to use the homestead, and the right to use the homestead will not be eliminated when the term expires.

To sum up, to apply for homestead, you should submit a written application to the village committee or village collective economic organization where the permanent residence is located. In any of the following circumstances, you can apply for homestead:

(three) the existing homestead area has not yet reached the quota standard stipulated in these measures and needs to be rebuilt or expanded;

(four) with household conditions and the original homestead area has not yet reached the limit standard stipulated in these measures, which needs to be rebuilt or expanded;

(five) with the approval of the county people's government, the professional and technical personnel introduced or recruited by rural collective economic organizations really need to settle in rural areas;

(six) retired workers, demobilized soldiers and overseas Chinese, their relatives, Hong Kong, Macao and Taiwan compatriots with legal documents to return to their original places to settle down;

(seven) as otherwise provided by laws, regulations and rules.
