I moved my hukou from the countryside to the city two years ago, and now I can't move it back. What should I do?

They not only found stable jobs in the city, but also bought cars and houses, married and had children, and settled down. In this case, rural friends will definitely move their accounts to cities. However, among those who moved their rural hukou to cities, many people wanted to move their hukou back, or because of work, school or other factors, so many rural friends asked Bian Xiao if they could move back after moving out of their rural hukou. It is basically impossible to move back after the rural hukou is moved out, but what Bian Xiao wants to say is that the answer is not unique. First of all, it depends on the circumstances under which you moved out and the reasons for moving back. Of course, the premise of all this is that the village Committee must agree. According to relevant departments, many college graduates can't find jobs after graduation. If they want to move their hukou back to their hometown, they must obtain the consent of the local village Committee. It should also be noted that whether ordinary people or college students want to move their hukou back to the countryside, they need the approval of the local village Committee.

Pay attention to the village committees that have been listed as "village to residence" and are not allowed to handle any non-agricultural immigrants; Unmarried people who have no fixed occupation and residence in cities and towns and live in rural areas with their parents; If the registered permanent residence moves out of junior college or technical school, and there is no work arrangement after graduation, it can be moved back to the original residence; One of the husband and wife is a rural hukou, and the non-agricultural registered permanent residence party has no fixed occupation in the town and has been living in the countryside; There is no fixed occupation in the town, but there are rural houses with homestead and existing house numbers, and they have been living in the countryside, unmarried children, etc. ; Eligible retired people's liberation army, armed police, non-commissioned officers and active personnel are allowed to be transferred back to their original places of residence. After the rural hukou is transferred out, what will happen to the land that belongs to you in the countryside? This is a problem that many people care about. For example, some people live in cities because of work, while others just don't live in rural areas, but their registered permanent residence is still in rural areas. In this case, how will the land be disposed of?

After the hukou is transferred out, that is, after the hukou is transferred to non-agricultural registered permanent residence, their land ownership is also different. We will explain this separately later. Some people think that when their household registration is transferred out, the land that originally belonged to them in the countryside, including farmland and homestead, will be recovered by the village and collectively disposed of. This was indeed the case before, but even before, it was divided into different situations and could not be generalized. Because in the past, it was stipulated that urban hukou could not enjoy the right to distribute rural land, it has always been implemented in this way, so many people feel that it is understandable to take it back. However, this rule has changed now, which is why we are going to discuss this issue today. If it is still the previous regulations, naturally there is nothing to say. Under the current new regulations, there are new regulations on the transfer of household registration and the ownership of rural homestead and farmland, so it is necessary for everyone to know what has changed here in order to determine their own land ownership in rural areas according to household registration.

Because there is no difference between them in the eyes of our rural people, they actually belong to two work categories. As we said before, there are two situations in this transfer. Some just don't live in the countryside, but their hukou is still in the countryside. In this case, our farmland is naturally protected. For example, because I do business in other places, I often don't live in my hometown in the countryside, but my land is still mine. If the village collective can't take it away, I will transfer it privately and contract it to others in the name of the village collective. This point is clearly stipulated in China's land contract law. Article 27 of Chapter II of the Land Contract Law stipulates that during the contract period, the employer shall not take back the contracted land. The state protects the land contractual management right of urban farmers. It is not allowed to withdraw from the contracted management right of land as a condition for farmers to settle in cities.
