How to make party member cadres not violate the relevant provisions of the Regulations on Disciplinary Actions of the Chinese Production Party?

Article 83 Party and state functionaries or persons entrusted with the management and operation of state-owned property embezzle, steal, defraud or illegally occupy public property by other means by taking advantage of their positions, and if the circumstances are relatively minor, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

Those who misappropriate party dues, social security funds and funds for disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and epidemic prevention shall be given a heavier or heavier punishment in accordance with the provisions of the preceding paragraph until they are expelled from the party.

Article 84 If the Party, state organs, state-owned enterprises (companies), institutions and people's organizations privately distribute state-owned assets to individuals in the name of units in violation of relevant regulations, the persons in charge who are mainly responsible and other persons who are directly responsible shall be held accountable, and if the circumstances are relatively minor, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

Where a disciplinary organ, an administrative law enforcement organ or a judicial organ, in violation of the relevant provisions, privately distributes the confiscated property that should be turned over to the state to individuals collectively in the name of the unit, the person in charge who is mainly responsible and the other persons who are directly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 85 Party and state functionaries or other personnel engaged in official duties take advantage of their positions to extort other people's property, or illegally accept other people's property to seek benefits for others. If the circumstances are relatively minor, they shall be given a warning or a serious warning. If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

The personnel listed in the preceding paragraph take advantage of their positions to illegally accept other people's property to seek benefits for others in disguise, and if the circumstances are serious, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party, kept on probation or expelled from the party.

Those who have caused great losses to the interests of the state, the collective and the people due to bribery shall be given a heavier or heavier punishment until they are expelled from the party.

Those who make things difficult for the other party to retaliate against the other party for attempting to obtain property and cause losses to the other party shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

Article 86 Party and state functionaries and other personnel engaged in public affairs who, in violation of regulations, accept property or kickbacks or service fees in various names in economic exchanges for personal possession shall be punished as accepting bribes in accordance with the provisions of Article 85 of these Regulations.

Article 87 Party and state functionaries and other functionaries who, by taking advantage of their positions, seek illegitimate interests for the trustee through the actions of other party and state functionaries, ask for the trustee's property, or accept or accept the trustee's property in disguise shall be dealt with in accordance with the provisions of Article 85 of these regulations.

Article 88 After retirement (resignation), party and state functionaries who seek benefits for the trustee by taking advantage of their original functions and powers or taking advantage of their positions through the actions of current party and state functionaries shall be dealt with in accordance with the provisions of Article 85 of these regulations.

Article 89 Where the Party and state organs, state-owned enterprises (companies), institutions and people's organizations demand or illegally accept other people's property, or illegally accept other people's property in disguised form to seek benefits for others, the persons who are mainly responsible and other persons who are directly responsible shall be investigated for responsibility. If the circumstances are serious, give a warning, a serious warning or revoke the party's duties. If the circumstances are serious, he shall be given probation or expelled from the party.

If the units listed in the preceding paragraph secretly accept kickbacks and service fees in various names outside the account during economic exchanges, they shall be punished as accepting bribes, and the main persons in charge and other persons directly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.

In case of making things difficult for subordinate units and customers due to the attempt to obtain property and causing losses to the other party, the principal responsible person and other directly responsible personnel shall be given a warning or a serious warning; If heavy losses are caused, he shall be dismissed from his post within the Party or be placed on probation; Causing heavy losses, be expelled from the party.

Those who privately divide the partnership income or illegally accept or illegally accept property in disguised form shall be punished as accepting bribes according to the amount of personal income and the role they play and in accordance with the provisions of Article 85 of these regulations.

Article 90 In order to seek illegitimate interests, giving property to party and state workers or other personnel engaged in public affairs, if the circumstances are minor, giving a warning or serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

In economic exchanges, those who, in violation of relevant regulations, give kickbacks or handling fees to party and state workers or other personnel engaged in public affairs in the form of property or in various names shall be dealt with in accordance with the provisions of the preceding paragraph.

Whoever causes great losses to the interests of the state, the collective and the people due to bribery shall be given a heavier or heavier punishment in accordance with the provisions of this article until he is expelled from the party.

Article 91 Whoever gives money or property to the Party and state organs, state-owned enterprises (companies), institutions and people's organizations in order to seek illegitimate interests, or gives kickbacks or service charges in various names in violation of regulations in economic exchanges, if the circumstances are minor, shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

If a unit commits one of the acts listed in the preceding paragraph, the main person in charge and other directly responsible personnel shall be dealt with in accordance with the provisions of the preceding paragraph.

Article 92 Bribery is introduced to party and state functionaries or other personnel engaged in public affairs, and if the circumstances are relatively minor, a warning or severe warning shall be given; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

Article 93 If a unit pays bribes for illegitimate interests, or in violation of relevant regulations, it gives kickbacks or service fees to party and state staff or other personnel engaged in public affairs in the form of property or in various names, the principal responsible person and other directly responsible personnel shall be investigated for responsibility, and if the circumstances are serious, it shall be given a warning, a serious warning, or the disciplinary action within the party shall be revoked; If the circumstances are serious, he shall be given probation or expelled from the party. If the illegal income from bribery is owned by individuals, it shall be handled in accordance with the provisions of Article 90 of these regulations.

Article 94 Party and state functionaries or persons entrusted with the management and operation of state-owned property, taking advantage of their positions, misappropriate public funds for personal use, engage in illegal activities or engage in profit-making activities, and if they fail to pay them back for more than three months, if the circumstances are minor, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the Party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.

Those who misappropriate party dues, social security funds and funds for disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and epidemic prevention shall be given a heavier or heavier punishment in accordance with the provisions of the preceding paragraph until they are expelled from the party.

Misappropriation of public funds for personal use for less than three months, but the amount is relatively large, shall be handled in accordance with the provisions of this article.

Article 95 party member, rural party organizations, community party organizations, villagers' committees, community residents' committees and other grass-roots organizations, taking advantage of the following positions, illegally occupy public property, misappropriate public funds, extort other people's property, or illegally accept or illegally accept other people's property in disguise to seek benefits for others, shall be dealt with in accordance with the provisions of Articles 83, 94 and 85 of these Regulations respectively:

(a) party dues, social security funds and disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief, epidemic prevention and other funds and materials management;

(two) the management of social donations to public welfare undertakings;

(three) the operation and management of state-owned land;

(four) the management of land expropriation compensation fees;

(5) Collecting and paying taxes;

(six) family planning, household registration and conscription;

(seven) to assist other administrative work of the people's government;

(eight) in accordance with the laws and regulations of the party to engage in the party's discipline inspection, organization (personnel), publicity and other work.

Article 96 If the property or expenditure of party and state functionaries or other public servants obviously exceeds their lawful income, and the difference is large, they may be ordered to explain the source, but I cannot explain the source legally. If the difference is based on illegal income, give a serious warning or revoke the party's post punishment. If the circumstances are serious, he shall be given probation or expelled from the party.

Party and state staff who conceal overseas deposits in violation of regulations shall be dealt with in accordance with the provisions of the preceding paragraph.
