1.8 105 working time limit

Holding a student visa means that international students are automatically allowed to work, but you can only work for up to 20 hours a week during the course. If a student works more than 20 hours a week, the Australian Immigration Department may decide whether to cancel the student visa held by the student.

There are exceptions to clause 8 105: first, there is no time limit for students to work during school holidays; Second, the work practice content contained in the courses applied by students is not limited by working hours; Third, students can't work before the start of the course, that is, they can't work before the official start date of the course marked on the school's registration confirmation (COE).

2. Article 8202 Study restrictions

After arriving in Australia with a student visa, students must maintain full-time study of registered courses, the attendance rate must be above 80% per semester, and their academic performance must meet the satisfaction of the school. So students must pay attention to their attendance. If the attendance rate of students is not ideal, carefully check the warning letter issued by the school to ensure that you are not absent from class continuously under controllable circumstances. As for grades, Australian schools have different tolerance for students' learning. Some require a score of over 50%, while others require a score of over 40%. However, in any case, poor grades are a very dangerous signal and should be dealt with in advance. Basically, every school that enrolls international students in Australia will set up a special international student counselor. For students who have serious difficulties in learning in the first semester, it is suggested to consult the counselor immediately or change courses.

Clause 8202 is a special clause set by the Australian Immigration Department in the student visa conditions in order to regulate the study abroad market and avoid the occurrence of illegal employment of international students coming to Australia for reasons other than studying abroad. As long as one of the above two requirements is not met, according to the law, the school must report to the Immigration Bureau immediately and notify the students in writing. In the letter, it will tell you that the visa condition 8202(3)(a) attendance or 8202(3)(b) score has been violated. You are required to explain to the Immigration Compliance Office within 28 days after the letter is sent.

As an overseas student, the Australian Immigration Department requires that you must always hold Overseas Student Insurance (OSHC) during your stay in Australia. After obtaining an Australian student visa, you must continue to abide by the conditions required for applying for a student visa. Mainly includes the following two points:

First of all, you must maintain the course study under the original visa category. If students want to switch between courses at the same level in the same school, they don't need to apply for a visa again, just inform the Immigration Bureau of the registration confirmation of the new course in time. If students want to change courses at different levels, they need to apply for a new student visa, because the types of student visas have changed. If students want to change schools, they need to get permission from the school, or at least complete the main courses in the original school for 6 months.

Second, you must continue to have enough financial ability to maintain your study and life during your stay in Australia.

5. Article 85 17

If the student visa holder has children under the age of 18 as accompanying students, then the visa holder must ensure that the school-age accompanying children attend school in Australia.

6. Article 8532

If the student visa holder is a student under the age of 18 and the school is the guardian, then the student cannot change the accommodation and guardian arranged by the school at will unless there is a written consent from the school.

7. Article 8533

Student visa holders must inform the school of your residence address within 7 days of arrival in Australia. If your address changes, you must inform your school within 7 days. If you transfer to another school or enter a higher school, you must also inform your original school within 7 days after receiving the new registration confirmation (COE).

If the length of the course you are studying is 10 months or less, no further stay clause will be attached to the student visa, that is to say, before the visa expires, students can't apply for any visa to extend their stay in China except immigration application and work permit, including student visa extension. Students must leave Australia after the visa expires. If students want to take other courses, they must return to China to apply for a new student visa.
