Chapter I General Provisions Article 1 In order to strengthen the management of the Yellow River, ensure the safety of flood control, and give full play to the social and ecological benefits of the Yellow River, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and the Regulations on the Management of Rivers in People's Republic of China (PRC), combined with the actual situation of this province. Article 2 These Regulations shall apply to the Yellow River channels within the administrative area of this province, including the main stream of the Yellow River and its estuaries, flood storage and detention areas, widening areas and Daqinghe River channels. Article 3 People's governments at all levels along the Yellow River shall strengthen their leadership over the management of the Yellow River and be responsible for organizing, coordinating, inspecting and supervising the management of the Yellow River within their respective jurisdictions. Fourth provinces, districts, cities and counties (cities, districts) in charge of the Yellow River is the competent authority of the Yellow River within their respective administrative areas.

The competent authorities of the Yellow River at all levels work under the leadership of the people's governments at the same level and the competent authorities at higher levels.

The relevant departments of the people's governments at or above the county level, such as land and resources, construction, transportation, water conservancy, marine and fishery, forestry, etc., shall, within the scope of their respective functions and duties, cooperate with the competent departments of the Yellow River to do a good job in the management of the Yellow River. Article 5 The competent authorities of the Yellow River at all levels must, in accordance with the provisions of laws and regulations, strengthen the management of the Yellow River, carry out flood control and water regulation instructions, and ensure the safety of water projects and people's lives and property. Article 6 The competent departments of the Yellow River at all levels shall, under the leadership of the local people's government and according to the actual situation along the Yellow River, take corresponding measures to protect the ecology, and help and support people in beach areas, flood storage and detention areas and widening areas to develop their economies and improve their living standards. Article 7 The competent departments of the Yellow River at all levels and water conservancy scientific research institutions shall strengthen the research on slowing down the sediment deposition, cut-off, sedimentation and irrigation in the floodplain, and scientifically utilizing the water resources and sediment of the Yellow River, so as to continuously improve the scientific level of the Yellow River. Article 8 All units and individuals have the obligation to protect the safety of the Yellow River channel and its projects, participate in flood control and flood fighting in the Yellow River, have the responsibility to protect the water quality of the Yellow River from pollution, and have the right to stop, report and accuse acts that destroy the Yellow River channel and its ancillary facilities and pollute the water environment. Ninth units and individuals that have made remarkable achievements in the management of the Yellow River shall be commended and rewarded by the people's governments at or above the county level or the competent department of the Yellow River. Chapter II River Regulation and Construction Article 10 River regulation and construction must conform to the planning of the Yellow River basin, the flood control standards stipulated by the state and other relevant technical requirements, and maintain the safety of the project, which is conducive to the stability of the river regime and the smooth flow of floods in the river. Eleventh in the Yellow River within the scope of management to build bridges, pontoons, dams, docks, ferries, roads, pipelines, cables and other buildings and facilities across the river, river, river and dike; When setting up water diversion, water lifting and drainage projects on dikes, the construction unit must apply to the competent authorities of the Yellow River and submit the project construction plan. Without the examination and approval of the competent authorities of the Yellow River, the construction unit shall not start construction.

Construction projects shall be put into use only after they have passed the acceptance inspection in accordance with relevant state regulations, and shall be brought into the unified management of flood control safety of the Yellow River. Article 12 If it is necessary to reinforce, rebuild or dismantle the existing engineering facilities within the management scope of the Yellow River due to the change of flood control standards or the reinforcement and reconstruction of the Yellow River flood control project, or the siltation of the Yellow River bed and the elevation of flood control water level, the original project construction unit or the competent department must reinforce, rebuild or dismantle them according to the requirements of the competent authorities of the Yellow River, and bear the expenses. Thirteenth construction, reinforcement of dikes and river regulation need to occupy land, should be in accordance with the principle of land conservation, land acquisition procedures in accordance with the law, and compensation in accordance with state regulations.

Land occupied by the construction and reinforcement of dikes and rivers shall be exempted or reduced from farmland occupation tax and land use tax in accordance with state regulations. The river boundary of urban planning and rural planning shall be determined by the competent department of the Yellow River in conjunction with the urban and rural planning department in accordance with the relevant provisions of the state.

The people's governments of cities, counties and townships (towns) along the Yellow River shall solicit the opinions of the competent department of the Yellow River in advance when organizing the preparation of urban planning and rural planning. Fifteenth yellow river beach area shall not be new towns and factories; If construction is really necessary due to special circumstances, it must be approved by the competent authorities of the Yellow River.

Villages and towns, factories and mines that have moved out of the beach area may not be able to come back. However, it is not allowed to build temporary houses for agricultural production. Article 16 Land use, development and various constructions in flood storage and detention areas must meet flood control requirements and maintain flood storage and detention capacity. Reclaiming land from lakes is prohibited in flood storage and detention areas. Chapter III River Protection Article 17 The scope of river management mentioned in these Regulations refers to the waters, sandbanks, beaches (including cultivated land), flood discharge areas, dikes on both sides of the river and dike protection areas between the dikes on both sides of the river; The reach without dike is determined according to the design flood level. Eighteenth within the scope of the Yellow River management, the use of water and land should meet the requirements of flood, water transport, shipping and ecological protection of the Yellow River.

The planning for the utilization of beaches, flood storage and detention areas and widened areas formulated by the people's governments at or above the county level shall conform to the planning of the Yellow River basin and give full consideration to the interests of local people. Utilization planning should include measures to help people develop their economy and improve their living standards, as well as corresponding support, compensation and assistance systems.
