Chapter I General Provisions Article 1 These Regulations are formulated in order to do a good job in resettlement for the construction of the Three Gorges Project on the Yangtze River, ensure the smooth progress of the Three Gorges Project and promote the economic development of the Three Gorges reservoir area. Article 2 These Regulations shall apply to the resettlement of the Three Gorges Project. Article 3 In the construction of the Three Gorges Project, the state implements the policy of development resettlement, and the relevant people's governments organize and lead the resettlement work, make overall use of resettlement funds, rationally develop resources, and properly resettle the migrants through multiple channels, industries, forms and ways based on agriculture, so as to make the living standards of the migrants reach or exceed the original level and create conditions for the long-term economic development and improvement of the living standards of the migrants in the Three Gorges reservoir area. Article 4 The resettlement of the Three Gorges Project adheres to the principles of state support, preferential policies, support from all parties and self-reliance, and correctly handles the relationship between the state, the collective and the individual. The flooded areas and resettlement areas of the Three Gorges Project should take the overall situation into account and obey the overall arrangement of the state.

The resettlement of the Three Gorges Project should be combined with the construction of the Three Gorges reservoir area, development along the Yangtze River, soil and water conservation and environmental protection to promote the economic development and ecological environment improvement of the Three Gorges reservoir area and create a good investment environment for the Three Gorges reservoir area. Article 5 To implement the development immigration policy and develop the economy in the Three Gorges reservoir area, we should rely on science and technology, attach importance to education and intellectual development, cultivate and introduce professionals, encourage scientific and technological research and popularize advanced technology. Article 6 The resettlement work of the Three Gorges Project shall be under the unified leadership of the central government, the responsibility of each province and the county-based management system.

The State Council Three Gorges Project resettlement management agency is in charge of the resettlement work of the Three Gorges Project.

The people's governments of Hubei Province and Sichuan Province are responsible for the resettlement work of the Three Gorges Project in this province, and set up the resettlement development and management institutions of the Three Gorges Project as needed.

The people's governments of the cities and counties where the flooded areas and resettlement areas of the Three Gorges Project are located are responsible for the resettlement work of the Three Gorges Project in the cities and counties, and set up the resettlement development and management institutions of the Three Gorges Project as needed. Chapter II Resettlement Article 7 To build the Three Gorges Project, a resettlement plan must be formulated. The Yangtze River Water Conservancy Committee of the Ministry of Water Resources shall, jointly with the people's governments of Hubei Province and Sichuan Province and the people's governments of the cities and counties where the Three Gorges reservoir area is located, formulate an outline of resettlement planning in accordance with the relevant provisions of the state, and prepare county (city) resettlement plans respectively according to the outline of the plan. The outline of resettlement planning shall be examined and approved by the office of the the State Council Three Gorges Project Construction Committee. County (city) resettlement planning, approved by the the State Council Three Gorges Project resettlement development and management agencies.

The approved resettlement plan is organized and implemented by the people's governments at all levels in Hubei Province, Sichuan Province and the Three Gorges reservoir area, and the resettlement development and management institution of the State Council Three Gorges Project supervises the implementation of the plan. Article 8 The construction land for the Three Gorges Project shall be approved at one time and allocated by stages according to the approved plan, and the land ownership registration formalities shall be handled according to law.

The compensation and resettlement funds for the construction land of the Three Gorges Project (hereinafter referred to as resettlement funds) determined in the overall resettlement plan approved by the State Council shall be used by the people's governments of Hubei Province and Sichuan Province and the people's governments of the cities and counties where the Three Gorges reservoir area is located in accordance with the unified planning arrangements for land development and arrangements for the production and life of immigrants. Article 9 Rural migrants should make rational distribution based on the development of large-scale agriculture, develop existing land, transform low-and medium-yield fields, build stable and high-yield grain fields and economic parks, and develop forestry, animal husbandry, fishing and sideline businesses. Where conditions permit, we should actively develop township enterprises, develop secondary and tertiary industries and resettle immigrants. Tenth Three Gorges Project immigrants should be placed in their own villages, townships, cities and counties; Villages, townships, cities and counties cannot be resettled, and they shall be resettled in this province; The province can not be placed, in accordance with the principle of economic and reasonable placement. Article 11 Where rural migrants are resettled to other rural collective economic organizations, the relevant municipal and county people's governments' resettlement development and management institutions shall negotiate and sign an agreement with the collective economic organizations in advance, and the collective economic organizations shall arrange the production and life of the migrants according to the agreement.

In accordance with the provisions of the preceding paragraph, rural collective economic organizations that resettle immigrants can use the resettlement funds allocated by the relevant municipal and county people's governments to transform and develop collectively owned low-yield fields and wasteland, and can absorb immigrants as new members in accordance with the agreement and treat them equally with the original members; The relevant municipal and county people's governments can also return the land after transformation and development to the collective economic organizations as compensation according to a certain proportion, and the rest of the land will be used to resettle immigrants, establish new collective economic organizations, and go through the formalities for the change of land ownership according to law.

Rural collective economic organizations that resettle immigrants can, under the leadership, make appropriate adjustments to the contracted management rights of cultivated land and other land contracted to individuals in a planned way, and rationally adjust the rights and obligations between the employer and the contractor. Twelfth cities and counties can not be resettled, and immigrants who need to move out for resettlement. The people's governments of cities and counties in the places of emigration and resettlement sign agreements with immigrants and go through relevant formalities. The people's government of the city or county where they moved out shall deliver the corresponding immigrant funds to the people's government of the city or county where they settled, and make unified arrangements for the production and life of the immigrants. Article 13 All the land of the land-expropriated units has been expropriated, and the immigrants who cannot be resettled according to the provisions of Articles 9 and 11 of this Ordinance can be transferred from agricultural registered permanent residence to non-agricultural registered permanent residence after being audited by the relevant municipal and county people's governments and approved by the provincial people's governments within the special control targets of the Three Gorges Project issued by the state, and the corresponding resettlement funds will be paid to the people's governments of the cities and counties where they live, which will arrange the production and life of the immigrants in a unified way.
