What kind of visa should graduates apply for paid internships in the United States?

After graduating in the United States, international students need to apply for an H-1B visa.

The H-1B visa is designed for professionals with a bachelor's degree or above to engage in professional work in the United States. According to the Immigration Reform Act of 1990, the annual H-1B visa quota is 65,000. Applicants must meet the following two conditions before they can apply for H-1B visa:

1. Professional requirements

According to immigration law, professional refers to work that can only be performed by professionals with at least a bachelor's degree. Professional positions must meet one of the following conditions:

2. The industry generally requires practitioners to have a bachelor's degree, or The job is extremely complex or unique, and only those with a professional degree can perform it;

Application procedures:

H-1B application is divided into two steps. First, the applicant's company should submit Form 9035 to the Department of Labor to prove that:

1. The applicant's wages will not be lower than those of similar U.S. workers;

2. When the applicant applied, there were no strikes or other activities in the company;

3. The applicant’s working conditions are the same as those of similar American workers;

Once Form 9035 is approved, the applicant can apply to the Immigration Bureau through the company where he works. Generally speaking, it takes two weeks for Form 9035 to be approved, and four weeks for the USCIS.
