Provisions of Changde Municipality on Implementing Measures for Collective Land Expropriation and Housing Demolition Compensation and Resettlement
Article 1 These Provisions are formulated in accordance with relevant laws and regulations and the Measures for Compensation and Resettlement of Collective Land Expropriation and House Demolition in Changde City (Chang Zi [2015] No.2), in order to standardize the compensation and resettlement work of collective land expropriation and house demolition in our county, and effectively protect the legitimate rights and interests of collective economic organizations, villagers (residents) and other obligees of the expropriated land.
Article 2 The Anxiang Municipal People's Government shall lead and organize the land requisition and demolition work in the county.
The county land acquisition and demolition headquarters was established to be responsible for the overall scheduling, overall coordination and overall planning of compensation and resettlement for collective land acquisition and house demolition within the county. The county magistrate is the chief commander, the deputy county magistrate in charge of urban construction and land work is the executive deputy commander, and other deputy county magistrates are the deputy commanders.
There is an office under the headquarters, which is responsible for supervising the implementation of compensation and resettlement procedures for land acquisition and demolition, identification of housing resettlement qualifications, and overall planning and distribution of resettlement houses. The office is located in the county land and resources bureau, with the director of the county land and resources bureau as the director of the office and the relevant functional departments in charge as the deputy director.
The project headquarters shall be established for specific land acquisition projects, and the county leaders in charge of relevant construction projects shall be the project commanders, directly responsible for the command, coordination and management of compensation and resettlement for land acquisition and demolition of specific projects. The leaders in charge of relevant departments and units and the heads of townships where the project is located are members, and they are responsible for assisting the project headquarters in the implementation of compensation and resettlement for land acquisition and demolition.
County Land and Resources Bureau is the legal subject of land requisition and demolition.
Township people's government is the main body of land acquisition and demolition work within its jurisdiction.
The county real estate bureau is responsible for the construction and management of apartment buildings.
County land, development and reform, finance, price, justice, public security, planning, housing construction, urban management, auditing, human society, civil affairs, taxation, industry and commerce, agriculture, forestry, animal husbandry and water, agriculture and economics and other departments shall do a good job in relevant work according to their respective responsibilities. The county economic management bureau shall, jointly with relevant departments, strengthen the supervision and management of the distribution and use of land acquisition compensation, a collective economic organization, and do a good job in the registration of changes in the contracted management right of rural land of landless farmers according to law.
Third, establish the working mechanism of "synchronization of three meetings", "joint examination of three halls" and "publicity of three lists" for sunshine demolition.
"Three synchronizations" means that the county land and resources bureau, the county financial investment evaluation center, the project land unit, the township people's government, the village (neighborhood) committee and the villagers' representatives where the project is located simultaneously carry out physical inventory, and investigate and confirm the ownership, land type, use, location, area and scope of the expropriated land, as well as the ground attachments and young crops of buildings such as village (neighborhood) houses. The findings must be signed by the "three parties".
The "third trial" means that the county land and resources bureau, the county financial investment evaluation center and the township people's government where the project is located will review and approve the demolition compensation and resettlement plan according to the survey results.
"Three list publicity" refers to the publicity of the proposed demolition and resettlement plan, demolition compensation plan and demolition compensation result.
Fourth county planning area of land acquisition, demolition and resettlement work to follow the principle of "resettlement before demolition".
The county land requisition and demolition headquarters shall draw up the apartment building plan according to the annual apartment building construction plan, and submit it to the county people's government for approval. The county planning department shall determine the location, and the county real estate bureau shall organize the implementation of the construction.
Fifth in any of the following circumstances, you can enjoy the qualification of resettlement housing:
(1) For families who were members of collective economic organizations and enjoyed the right of distribution within the collective economic organizations before the land was expropriated, the status quo of relocated households is "one household, one house" (natural courtyard is one household);
(two) the head of the household moved from other rural areas and settled in the collective economic organizations whose land was expropriated, and now belongs to the rural household registration;
(3) Households that need to be relocated due to leveling dikes, resettlement to build towns and national construction move into collective economic organizations with expropriated land, and the homestead is allocated by the collective economic organizations;
(4) Other circumstances stipulated by laws and regulations.
Housing resettlement qualification is based on holding collective land use certificate and housing ownership certificate issued by relevant competent departments. There is no relevant proof, provided by the township and village level, the county land acquisition and relocation office for examination and confirmation, and posting publicity. If there is no objection, it is regarded as a legal building and can enjoy the qualification of housing placement.
In accordance with the first paragraph (two), (three) and (four) of this article, the village (community) shall provide relevant certification materials.
Sixth meet one of the following conditions, can obtain the qualification of household resettlement:
(a) the relocated households have many children, and all the children are married without a house or the per capita living area is less than 40 square meters (their parents must live with one of the children);
(two) the relocated households have many children, unmarried children have reached the age of late marriage, and the per capita living area is below 40 square meters (parents must live with one of their children);
(three) when the announcement of land acquisition, the divorce and property division procedures have been handled according to law for more than one year, and the household registration is still in the local area, and there is really no room.
Article 7 Housing resettlement includes monetary resettlement, apartment resettlement and reconstruction resettlement.
Encourage the choice of monetary resettlement or apartment-style resettlement in the county planning area.
In the county planning area, if the demolished choose monetary resettlement, monetary resettlement subsidies shall be given according to the resettlement area that the demolished should enjoy.
If the demolished people in the county planning area choose apartment-style resettlement, they can choose two resettlement methods of 240 square meters and 120 square meters according to the administrative area. In order to encourage the choice of 120 square meters, the relocated households who choose 120 square meters apartment will be given a cash reward of 10000 yuan. The difference between the resettlement area that residents in the county planning area should enjoy and the actually selected apartment construction area shall be subsidized in the form of housing monetary resettlement subsidies.
The housing monetary resettlement subsidy standard within the county planning area of Jin Ryu is 500 yuan/square meter (including land-saving incentives); The housing monetary resettlement subsidy standard in Dajinggang Town (including Hexi Industrial Park) within the county planning area is determined by the county industrial concentration zone management committee according to the actual regional economic level.
If the county planning area chooses to rebuild and resettle, it will be rebuilt in the resettlement community designated by the county land acquisition and demolition headquarters after obtaining the approval procedures for construction planning land.
Article 8 For those who meet the housing resettlement conditions, the housing resettlement subsidy shall be calculated according to their legal housing area (excluding houses with detached houses and shacks), and the legal housing area of less than 240m2 shall be calculated according to 240m2.
Housing resettlement subsidy is calculated according to the standard of 200 yuan/m2.
If apartment-style resettlement is selected, the apartment building will be resettled according to the standard of 240㎡/ household, and the housing resettlement subsidy in the housing resettlement area will not be paid to the demolished person, and will be used as a whole for the construction of apartment building resettlement houses; You can also choose 120㎡ resettlement house, and the remaining area can be paid to the demolished person in full according to the document standard.
Choose monetary resettlement, housing resettlement subsidies paid in full to the demolition.
Choose scattered self-built reconstruction and resettlement (outside the urban planning area), housing resettlement subsidies paid in full to the demolition. If the housing resettlement subsidy for each household is less than 48,000 yuan, it will be paid according to the standard of 48,000 yuan.
Ninth objects that meet the resettlement conditions can only be resettled once within the scope of the same village collective economic organization.
Those who choose monetary resettlement or apartment-style resettlement shall not build their own houses within the scope of village-level collective economic organizations in any name.
Tenth people with housing resettlement qualifications choose monetary resettlement, according to the standard of 30 thousand yuan/household to give land-saving award.
Eleventh eligible households, increase 120㎡ to calculate housing resettlement subsidies, and increase 120㎡ to resettle housing area when choosing apartment-style resettlement.
Article 12 The interior and exterior decoration and ancillary facilities of the demolished residential houses shall be compensated in lump sum according to the housing structure category and construction area (see Annex for specific compensation standards).
Thirteenth housing ancillary facilities that do not involve house demolition within the red line of land acquisition shall be compensated at the replacement cost price.
Article 14 The compensation standard for moving graves is: earth monument 1.500 yuan/seat, cement and brick monument 2000 yuan/seat.
During the notice period of moving the grave, those who fail to move within the time limit will be moved to the cemetery resettlement area for burial by the funeral professional team, and photos will be taken and preserved in the process of moving the grave for the convenience of the relatives of the grave owner, but no compensation will be given.
Fifteenth in the specified time for others to vacate the house, to give incentives for others to vacate the house, incentives for others to vacate the house according to the standard of 30 thousand yuan per household included in the capital budget.
If the house demolition agreement is signed within 1 month after the resettlement compensation scheme is publicized, a reward of 30,000 yuan will be given; If it exceeds 1 month, but the house demolition agreement is signed within the time specified by the project headquarters and the house is demolished on time, a reward of 20,000 yuan will be given; If the house demolition agreement is signed within the time specified by the project headquarters, the reward will be cancelled.
Tengdi Award is issued by the county land acquisition and demolition headquarters and the county financial investment evaluation center.
Article 16 The houses that have signed the demolition compensation and resettlement agreement shall be demolished by the demolition implementation agency, and the house demolition fee shall be fully included in the fiscal budget according to 10 yuan/m2, and shall be used by the county land acquisition and demolition headquarters as a whole.
Article 17 The overall funds for land acquisition and demolition, unforeseen expenses for land acquisition and demolition (3% of the total compensation for land acquisition and demolition), compensation funds for land acquisition and demolition (3% of the total compensation for land acquisition and demolition), incentive funds for supporting compensation and resettlement for house demolition (2% of the total compensation and resettlement for house demolition) and lost time expenses (subject to the standards specified in document Changfa [20 15]2) are all included in the budget of the compensation scheme for land acquisition and demolition.
Eighteenth landless farmers in accordance with the relevant policies and procedures to buy social endowment insurance.
The retained part of land acquisition compensation, a collective economic organization, should be mainly used for social security subsidies for farmers whose land has been expropriated, and the Township People's Government at the place where the land has been expropriated will make overall arrangements.
Collective economic organizations whose land has been expropriated shall, when signing the land expropriation agreement, submit the land expropriation compensation distribution plan and the roster of insured persons together.
Nineteenth "Changde collective land expropriation and house demolition measures" (Chang [2015] No.2) has been published before the implementation of the land acquisition compensation and resettlement plan, according to the standards determined in the original announcement to continue to implement.
