How do foreigners apply for a work visa when they come to work in China?
1. Before the employer intends to hire foreigners to work in China, it shall apply for a foreigner employment permit.
2. The employing unit that is allowed to recruit foreigners shall present the employment certificate for foreigners issued by the administrative department of labor and social security;
3. Foreigners who are allowed to work in China should apply for a professional visa in embassies and consulates in China with a license issued by the labor department, a letter and telegram from the authorized unit and their valid passports or certificates that can replace passports;
4. The employing unit shall, within fifteen days after the entry of a foreigner who has obtained a professional visa, go to the Labor and Social Security Bureau with relevant materials to handle the Alien Employment Certificate for the foreigner.
Foreigners who have obtained employment permits should apply to the public security department for residence permits within 30 days after entering the country.
Materials required to apply for a foreigner's employment permit:
1. Report on the reasons for the proposed employment of foreigners (the reasons for employment shall be specified in detail);
2. The original and photocopy of the employer's industrial and commercial registration certificate or legal person registration certificate, and the original and photocopy of the organization code certificate. Enterprises with foreign investment shall provide the original and photocopy of the approval certificate;
3. A copy of the foreigner's valid passport (visa);
4. Letter of intent to be employed (including detailed labor terms);
5. Resume of the foreigner to be hired (including the latest study experience), academic certificate and qualification certificate of the post to be hired (note: the resume contains the final academic degree and complete experience of the individual and must be printed in Chinese and confirmed and stamped by the employer; If the job resume and academic certificate are in foreign languages, they shall be translated into Chinese at the same time, which shall be confirmed and sealed by the employer. Qualification certificate refers to the relevant qualification or technical skill certificate issued by relevant institutions. If it is in a foreign language, it shall also provide a Chinese translation and be confirmed and sealed by the employer);
6. Original and photocopy of the health certificate of the foreigner to be employed;
7. Fill in a complete employment registration form for foreigners in duplicate;
8. Two recent bareheaded two-inch photos of foreigners to be hired;
9. Fill in the Application for Administrative License of XX Municipal Labor and Social Security Bureau 1 copy (official seal of the unit is required).
Materials required to apply for a foreigner's employment permit:
1. Application report of the employing unit for the Employment Certificate for Foreigners (the reasons for employment shall be specified in detail);
2. The original and photocopy of the employer's industrial and commercial registration certificate or legal person registration certificate, and the original and photocopy of the organization code certificate. 6. Original and photocopy of the health certificate issued or confirmed by the entry-exit inspection and quarantine department (note: International Travel Health Care Center for Entry-Exit Inspection and Quarantine);
7. Fill in a complete employment registration form for foreigners in duplicate;
8. Three recent two-inch bareheaded photos of foreigners;
9. The original Alien Employment Certificate for the foreigner;
10. The chief representative and representative of the resident representative office of a foreign (regional) enterprise must also provide the original and photocopy of their valid work permit. If he holds the post of deputy general manager or above in the employing unit, he shall provide the resolutions and articles of association of the board of directors separately. If there is no board of directors, the articles of association and the letter of appointment signed by the legal representative shall be provided.

Regulations on the Administration of Employment of Foreigners in China
Chapter II Employment Permit
Article 5 The employing unit must apply for an employment certificate for foreigners and obtain the Employment Certificate for People and Foreigners in China (hereinafter referred to as the Employment Certificate) before employing the foreigner.
Article 6 The position of employing foreigners by the employing unit shall be a special need position for the temporary lack of suitable candidates in China, and it shall not violate the relevant provisions of the state. The employing unit shall not employ foreigners to engage in commercial cultural performances, except those that meet the requirements of Item (3) of Article 9 of these Provisions.
Article 7 Foreigners who want to work in China must meet the following conditions:
(a) at least 18 years old and in good health;
(2) Having the professional skills and corresponding work experience necessary for engaging in their work;
(3) No criminal record;
(4) Having a definite employer;
(5) Holding a valid passport or other international travel documents that can replace passports (hereinafter referred to as documents that can replace passports).
Article 8 Foreigners employed in China shall enter the country with a professional visa (if there is a visa-free agreement, it shall be handled according to the agreement), and after entering the country, they shall obtain the Employment Certificate for Foreigners (hereinafter referred to as the Employment Certificate) and the Residence Certificate for Foreigners before they can be employed in China.
Foreigners who have not obtained residence certificates (that is, those who hold F, L, C and G visas), foreigners who study and practice in China, and accompanying family members of foreigners who hold professional visas are not allowed to work in China. Under special circumstances, the employer shall apply for permission according to the examination and approval procedures stipulated in these Provisions. Foreigners who have been employed can change their identity with this card and apply for employment permit and residence permit before they can be employed.
