Measures of Hunan Province on the Administration of Immigrant Funds

Article 1 In order to strengthen the management of resettlement funds for water conservancy and hydropower projects in our province, improve the efficiency in the use of funds, properly solve the production and living problems of immigrants in the reservoir area, help the immigrants in the reservoir area to develop the economy and ensure the stability of the reservoir area, these measures are formulated in accordance with the relevant laws and regulations and the provisions of the State Council on strengthening the management of resettlement funds, combined with the actual situation in our province. Article 2 Resettlement funds are special funds raised according to relevant laws and regulations and the provisions of the people's governments of the State Council and the province and their relevant departments for the resettlement of water conservancy and hydropower projects and for helping the migrants in the reservoir area to develop their economy. Article 3 Immigrant funds belong to extra-budgetary funds and are managed by special financial accounts. In accordance with the principle of "unified policy, hierarchical management, first receiving and then supporting, earmarking, and paying attention to benefits", under the leadership of people's governments at all levels, it is managed by immigration development institutions and financial departments at all levels. Article 4 Immigrant funds shall not be used to balance the fiscal budget and non-immigrant projects, and the balance of the current year shall be carried forward to the next year for use. Article 5 Resettlement funds include reservoir construction fund, reservoir post-support fund, reservoir maintenance fund, resettlement assistance fund, reservoir inundation treatment compensation fee (referred to as inundation compensation fee), special funds for reservoir development, electricity surcharge, water surcharge, resettlement grain price difference subsidy and other funds specially used for resettlement projects and resettlement production and life.

After the resettlement funds are collected by the relevant collecting units, they will be paid in full and on time into the financial accounts of extra-budgetary funds (resettlement funds) opened by the Provincial Department of Finance in the bank, and the reminder of resettlement funds will be jointly responsible by the Provincial Immigration Development Bureau and the Provincial Department of Finance.

The reservoir construction fund shall be directly allocated to the local (city, state) and county (city, district) immigration agencies by the Provincial Immigration Development Bureau according to the projects approved by the provincial people's government. The fixed grain subsidy for immigrants collected by the Provincial Department of Finance shall be timely allocated to the Provincial Immigration Development Bureau by the Provincial Department of Finance according to the plan approved by the provincial people's government, and allocated to cities, prefectures and counties (cities, districts) by the Provincial Immigration Development Bureau; Where the immigrant funds paid into the financial accounts are put forward by the Provincial Immigration Development Bureau, and approved by the Provincial Planning Commission and the Provincial Department of Finance, the Provincial Immigration Development Bureau and the Provincial Department of Finance jointly issued a document for implementation. The Provincial Department of Finance will allocate funds to the Provincial Immigration Development Bureau as planned, and the Provincial Immigration Development Bureau will allocate funds to the county (city, state) immigration development institutions where the funds are used according to the progress of the project. Article 7 The scope of use of resettlement funds:

(three) compensation for resettlement housing, production development, market town relocation and professional project reconstruction in the reservoir area of new water conservancy and hydropower projects;

(four) resettlement subsidies, the development of production subsidies, to solve the cross county (city, district) resettlement area construction and legacy problems.

Immigration funds must be used in strict accordance with the above provisions, and all departments and units at all levels shall not misappropriate them. Eighth immigration funds to implement the annual budget and final accounts examination and approval system. Immigration development institutions at all levels should prepare the next year's immigration fund revenue and expenditure budget before 12 every year, and report it to the government at the same level for approval after being audited by the financial department at the same level; Immigration development agencies and financial departments at all levels should strictly follow the approved budget. If it is necessary to adjust the budget, it must be reviewed by the financial department at the same level in consultation with the immigration development institution and reported step by step. Within 3 months after the end of the year, the immigration development institution shall prepare the annual final accounts of revenue and expenditure and send them to the finance department at the same level for examination and approval. The annual revenue and expenditure final accounts report shall be true in data, complete in content and submitted in time. Immigration development institutions and financial departments at all levels should review and summarize the final accounts at the same level and the final accounts at the next level. Ninth immigration development institutions at all levels shall submit financial statements to the finance department at the same level and the immigration development institutions at the next higher level on a quarterly basis. The format and preparation method of the budget and final accounts of resettlement funds shall be formulated by the Provincial Department of Finance and the Provincial Immigration Development Bureau. Tenth counties and cities in the reservoir area must, according to the requirements of engineering and project management, make the next year's resettlement fund plan within the specified time. Eleventh where the resettlement funds are used to arrange the basic construction and project investment of the reservoir area, it must be approved by the Provincial Immigration Development Bureau and the Provincial Department of Finance, and approved according to the basic construction procedures. Twelfth financial departments at all levels and immigration development institutions to raise special funds for immigrants and their interest income belong to extra-budgetary funds, which are included in the management of financial accounts. According to the Notice of the Ministry of Finance of People's Republic of China (PRC) State Taxation Administration of The People's Republic of China on Adjusting the Business Tax Policy of Administrative Fees (Funds) (Caishuizi [1997] No.5), business tax and other taxes are exempted. Thirteenth all state-owned and collective assets formed by the investment of immigrant funds and labor services shall be managed by the financial department at the same level and the immigration development institutions authorized by governments at all levels, and no non-immigrant unit or non-immigrant may occupy them.
