Recently, the Population Office of the Shanghai Public Security Bureau made an interpretation on the issues related to Article 46 of the New Regulations on the Management of Permanent Accounts in Shanghai, which will be implemented on May 1.

Q: Is this rule new?

A: As early as 2003, the Ministry of Public Security promulgated and implemented 30 measures to facilitate the people and benefit the people, clearly stipulating that people who have been abroad for more than 1 year shall not cancel their accounts, but those who have settled abroad shall cancel their accounts.

In 2005, 2008, 20 10, and 20 15, the Regulations on the Administration of Permanent Residence in Shanghai all stipulated that those who settled abroad should cancel their accounts.

Q: According to Article 46, who needs to cancel the account?

A: Those who go abroad to settle down or join a foreign nationality need to cancel their household registration. Those who have not settled abroad for a long time do not belong to those who should cancel their accounts as mentioned in these Provisions.

Q: How can people who have settled abroad or joined a foreign nationality cancel their accounts?

A: The above-mentioned personnel should cancel their accounts. According to my application, those who join a foreign nationality need to provide a foreign passport. People who go abroad to settle down need to provide foreign visas including immigration, settlement, obtaining foreign residency and other reasons. The above two types of personnel are required to provide their identity certificates and household registration books. If it is necessary for others to handle it, a lawyer or notary must be entrusted to handle it. The agent also needs to provide identification.

Q: How can the public security organs cancel the accounts of people who have settled abroad without taking the initiative to apply for cancellation?

A: After investigation, the public security organ can only cancel its account if there is evidence such as a visa issued by the country of residence, including the reasons for immigration, settlement and permanent residence, as well as the fact of living and living in a foreign country for a long time.

Q: Can I resume my account after going abroad for cancellation?

A: If you cancel your account abroad, you can resume your account when you return to China to settle down. Among them, those with overseas Chinese status shall be examined and approved by the Municipal Overseas Chinese Affairs Office; Those who do not have the status of overseas Chinese shall be examined and approved by the exit-entry administration department of the Municipal Public Security Bureau.
