Regulations of Yulin Municipality on the Protection of Water Quality in Jiuzhou River Basin

Chapter I General Provisions Article 1 In order to improve and protect the water quality of Jiuzhou River Basin, prevent and control water pollution, safeguard public health and promote sustainable economic and social development, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Water Pollution of People's Republic of China (PRC) and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the water quality protection activities in Jiuzhou River Basin within the administrative area of this Municipality.

The Jiuzhou River Basin as mentioned in these Regulations refers to the rainwater collection range of surface water bodies such as the main stream, tributaries, reservoirs and channels of Jiuzhou River that flows through the towns along Luchuan and Bobai counties within the administrative area of this Municipality and reaches Panlongwei, the ancient town of Luchuan County. The specific scope shall be determined by the Municipal People's Government and announced to the public. Article 3 The water quality protection in Jiuzhou River Basin adheres to the principles of government leading, public participation, protection priority, overall planning, comprehensive management and territorial management. Article 4 The Municipal People's Government shall exercise unified leadership over water quality protection in Jiuzhou River Basin, and be responsible for organizing, guiding and supervising the work.

The people's governments at the county level shall be responsible for the planning, implementation, pollution prevention, supervision and management of water quality protection in Jiuzhou River Basin within their respective administrative areas in accordance with their administrative authority.

The competent administrative department of environmental protection is responsible for the unified supervision and management of water quality protection in Jiuzhou River Basin.

The water administrative department shall be responsible for the compilation and revision of water functional zoning, the setting permission of sewage outlets into the river, the verification of the total amount of pollutant discharge restricted by river functional areas, and the supervision and management of sand mining in the river.

The administrative department of agriculture and animal husbandry is responsible for the comprehensive utilization of livestock and poultry breeding waste, the supervision and management of the harmless treatment of dead livestock and poultry and other related work.

Development and reform, industry and information technology, public security, finance, land and resources, housing and urban construction, transportation, industry and commerce, agriculture, forestry, health and family planning, food and drug supervision, maritime affairs and other departments shall, according to their respective responsibilities, do a good job in water quality protection in Jiuzhou River Basin.

Township people's governments shall be responsible for the protection of water quality within their respective administrative areas in accordance with their management authority, assist the competent administrative department of environmental protection and other relevant departments in the implementation of pollution prevention and control of livestock and poultry breeding, river cleaning and other work, and implement relevant law enforcement work in accordance with the authorization of these regulations. Article 5 The water quality protection of Jiuzhou River Basin shall be implemented by the river length system, and the city, county and town river heads shall be set up, and the village river heads shall be set up according to the actual needs of protection and management, and the river heads at all levels shall organize and lead the water quality protection work of Jiuzhou River Basin at the corresponding level.

The list of river chiefs at all levels should be announced to the public, and the river chief publicity board should be located in a prominent position on the river bank and the reservoir area. Article 6 The municipal and county people's governments shall establish the target responsibility system and assessment system for water quality protection and management in Jiuzhou River Basin, as an important basis for the assessment of people's governments at all levels and their responsible persons, water quality protection supervision and management departments and their responsible persons.

The municipal and county people's governments shall regularly report to the people's congress at the same level or the Standing Committee of the people's congress on the water quality protection work in Jiuzhou River Basin. Seventh people's governments at the county level shall include the funds needed for water quality protection in Jiuzhou River Basin in the fiscal budget at the corresponding level.

The Municipal People's Government shall, according to the needs of water quality protection in Jiuzhou River Basin, give appropriate financial support to pollution source remediation, ecological protection, water environment management capacity building, water quality protection and scientific research in Jiuzhou River Basin. Article 8 The Municipal People's Government shall establish an inter-county joint prevention and control mechanism for water quality protection in Jiuzhou River Basin, regularly carry out joint emergency drills, establish an inter-county data sharing mechanism, and regularly exchange supervision and management information. Article 9 The municipal and county people's governments shall, according to the actual situation of water quality protection in Jiuzhou River Basin, organize environmental protection, water conservancy, aquatic animal husbandry and veterinary, development and reform, industry and information technology, public security, land and resources, housing and urban construction, transportation, safety supervision, agriculture, forestry, health and family planning, food and drug supervision, tourism, industry and commerce, water supply, power supply, maritime affairs and other departments to jointly enforce the law, and investigate and deal with illegal acts according to law. Article 10 Any unit or individual has the right to report water pollution to the water quality protection supervision and management department of Jiuzhou River Basin, and the department that accepts the report shall verify and report according to law, and keep the informer confidential.

Any unit or individual has the right to report to its superior organ or supervisory organ the acts of the water quality protection supervision and management department of Jiuzhou River Basin and its staff who fail to perform their duties according to law. Eleventh city, county and township people's governments and their relevant functional departments should strengthen the publicity and education of water quality protection in Jiuzhou River Basin, popularize the knowledge of water quality protection, and enhance the public's awareness of water quality protection.

Radio, television, newspapers, government portals and other media should strengthen publicity and public opinion supervision on water quality protection in Jiuzhou River Basin. Article 12 The municipal and county people's governments shall establish a public participation mechanism for water quality protection in Jiuzhou River Basin, improve the methods, procedures and guarantees of public participation, and provide convenience for public participation in water quality protection in Jiuzhou River Basin.

Encourage enterprises, social organizations and other organizations and individuals to invest, donate or participate in water quality protection in Jiuzhou River Basin in other ways.

The municipal and county people's governments and relevant functional departments shall listen to public opinions and give feedback in an appropriate way before making major decisions on water quality protection in Jiuzhou River Basin or building projects that may have a significant impact on water quality.
