Article 2 These Measures shall apply to the construction activities, supervision and management of rural villagers' new construction, renovation and expansion of rural housing within the administrative area of this province. Article 3 The construction of rural housing should follow the principles of planning first, one house for one household, adjusting measures to local conditions and protecting the ecological environment, and reflect the local history, culture, regional characteristics and rural features. Article 4 The people's governments at or above the county level shall strengthen their leadership over the management of rural housing construction, incorporate rural housing construction into the national spatial planning, and incorporate funds such as the compilation of village planning and rural housing construction atlas, the construction of public facilities in concentrated residential areas, relevant incentives and subsidies, and law enforcement management into the fiscal budget at the corresponding level.

The competent department of housing and urban and rural construction of the people's government at or above the county level is responsible for the supervision and management services such as the design and construction of rural housing construction; The competent department of natural resources of the people's government at or above the county level is responsible for the supervision and management services such as rural housing construction plan, agricultural land conversion and housing ownership registration; The competent agricultural and rural departments of the people's governments at or above the county level shall be responsible for the supervision and management services of rural housing construction; The competent departments of finance, transportation, water conservancy, ecological environment and forestry of the people's governments at or above the county level shall be responsible for the relevant management services of rural housing construction according to their respective responsibilities. Article 5 Township people's governments are specifically responsible for the management, supervision and service of rural housing construction, and implement relevant administrative examination and approval and comprehensive law enforcement on villagers' housing construction according to the authorization of laws and regulations and the entrustment of relevant competent departments of the people's governments at the county level. Article 6 The villagers' committee shall, under the guidance of the township people's government, formulate village rules and regulations with the autonomous management of villagers' housing construction as the content, which shall be implemented after being discussed and approved by the villagers' meeting; Guide the villagers to handle or handle the examination and approval procedures for rural housing construction on behalf of the villagers, and guide the villagers to carry out rural housing construction activities according to the law and regulations; Timely discourage illegal acts in rural housing construction and report to the township people's government. Seventh Township People's governments shall organize the preparation of village planning. Village planning should fully consider the actual needs of rural production and life, solicit villagers' opinions, make overall arrangements for homestead land, and reasonably determine the layout, scope, scale and supporting facilities of rural residential areas. The approved village planning shall be strictly implemented and shall not be modified without authorization. If it is really necessary to modify it, it shall be approved by the original examination and approval authority and organized in accordance with legal procedures. Eighth rural housing construction should conform to the village planning. Located in nature reserves, scenic spots, cultural relics protection units, historical and cultural villages, traditional villages and other areas, it should also comply with the relevant protection plans. Building site selection should make full use of the original homestead, parking lot and other unused land, avoid geological disasters, floods, underground mined-out areas, earthquake fault zones and other dangerous areas, and strictly control slope cutting for building. If it is really necessary to cut the slope due to the difficulty in site selection, it shall, under the guidance of the Township People's Government, do a good job in slope protection in accordance with relevant technical specifications to ensure the safety of the building.

Promote the increase or decrease of urban and rural construction land, encourage the construction of rural housing in combination with market town construction, new rural construction and comprehensive improvement of rural land, and realize the moderate and orderly concentration of new housing for villagers.

When building a house along the highway, the distance between the edge of the house and the outer edge of the highway land shall be no less than 20m for the national highway, no less than15m for the provincial highway, no less than10m for the county road and no less than 5m for the township road. In the construction of houses along the expressway, the distance between the edge of the house and the isolation guardrail of the expressway is not less than 30 meters. Building houses in the railway line safety protection zone and around the airport shall abide by the relevant laws and regulations on railway safety protection and airport management.

Rural villagers can only own one homestead, and the area of each household shall not exceed the standards set by the province. The people's governments of cities, autonomous prefectures and counties (cities) divided into districts shall, in accordance with relevant laws and regulations and local conditions, formulate and publish rural housing construction standards, and strictly control the number of building floors and the height of buildings.

Township people's governments and villagers' committees shall select demonstration drawings accepted by most local villagers from the housing design drawings provided free of charge by the competent department of housing and urban and rural construction of the people's government at the county level, and promote their use. Encourage villagers to build new houses in accordance with the demonstration plan and gradually form an architectural style that conforms to regional characteristics. Article 9 It is forbidden to build houses in the following areas:

(1) Permanent basic farmland areas;

(two) drinking water source protection areas;

(3) Management scope of rivers and lakes;

(4) Building control zones on both sides of highways;

(5) Other areas prohibited by laws and regulations. Tenth meet one of the following conditions, villagers can apply for housing:

(two) the existing housing belongs to the old house and needs to be demolished and rebuilt;

(three) the original housing needs to be rebuilt due to the disaster;

(five) other circumstances stipulated by laws, regulations and rules. Eleventh villagers to apply for housing, one of the following circumstances, shall not be approved:

(1) Not a member of a collective economic organization;

(two) does not conform to the village planning;

(three) does not meet the requirements of one household and one house;

(4) Selling, leasing, giving to others or converting the original house into production and business purposes;

(5) An application for disputes over the ownership of the homestead;

(six) other circumstances of disapproval as stipulated by laws, regulations and rules.
