Chapter I General Provisions Article 1 In order to standardize the resettlement work of large and medium-sized water conservancy and hydropower projects, safeguard the legitimate rights and interests of migrants and ensure the smooth progress of project construction, these Regulations are formulated in accordance with the Regulations of the State Council on Compensation and Resettlement for Land Acquisition of Large and Medium-sized Water Conservancy and Hydropower Projects and relevant laws and regulations, and in combination with the actual situation in Sichuan Province. Article 2 These Regulations shall apply to the planning, resettlement, later support, supervision and management of immigrants from large and medium-sized water conservancy and hydropower projects within the administrative area of Sichuan Province. Article 3 The resettlement work of large and medium-sized water conservancy and hydropower projects follows the policy of development resettlement, adheres to the principle of people-oriented, scientific and reasonable, standardized and orderly, and implements the mechanism of government leadership, graded responsibility, county-level participation, project legal person and resettlement, technical responsibility of planning and design units, and follow-up supervision of supervision and evaluation units. Article 4 The people's governments of provinces, cities (prefectures) and counties (cities, districts) shall be responsible for organizing and leading the resettlement work of large and medium-sized water conservancy and hydropower projects within their respective administrative areas, establishing a coordination mechanism for resettlement work, and organizing and coordinating major issues in the resettlement work within their respective administrative areas.

County (city, district) people's government is responsible for resettlement of large and medium-sized water conservancy and hydropower projects, management and use of resettlement funds, publicity of resettlement policies, and maintenance of social stability.

The people's governments of townships (towns) and sub-district offices shall actively cooperate with the governments at higher levels and relevant departments to perform their duties of immigration, and guide grassroots mass autonomous organizations such as villagers' committees and residents' committees to carry out immigration work. Article 6 The departments of development and reform, civil affairs, finance, auditing, land and resources, housing and urban construction, transportation, water conservancy, agriculture, forestry and environmental protection of local people's governments at or above the county level shall be responsible for doing a good job in immigration-related work within their respective functions and duties. Article 7 The project legal person shall be responsible for compiling the outline of resettlement planning and resettlement planning, securing resettlement funds and participating in resettlement work. The comprehensive immigration supervision unit is responsible for the supervision of the whole process of resettlement and participates in the resettlement work.

Article 9 Immigrant individuals, rural collective economic organizations and organs, enterprises and institutions that relocate or rebuild shall enjoy corresponding rights and perform corresponding obligations according to law. Chapter II Resettlement Planning Article 10 For large and medium-sized water conservancy and hydropower projects that have established a project legal person, the project legal person shall prepare a resettlement plan and an outline of the resettlement plan.

For large and medium-sized water conservancy and hydropower projects without a project legal person, the competent engineering department, together with the resettlement areas and local people's governments at or above the county level, shall be responsible for compiling the outline of resettlement planning and resettlement planning. Article 11 The project legal person or the competent department of the project shall prepare the detailed rules and work plan for the physical investigation, and after soliciting the opinions of the people's governments of provinces, cities (prefectures), resettlement areas and resettlement areas and counties (cities, districts), it shall be used as the elements for reporting the notice of suspension of work and the basis for carrying out the physical investigation. Twelfth project legal person or the competent department of the project shall, before the physical investigation, apply to the people's government of the county (city, district) where the water conservancy and hydropower project covers an area and is submerged. Notice of suspension of construction by the county (city, district) people's government submitted to the provincial people's government for approval and release.

After the notice of suspension of construction is issued, it shall be implemented in accordance with the validity system stipulated by the provincial people's government. Thirteenth after the announcement of the suspension of construction, the project legal person or the competent department of the project shall, in conjunction with the people's government of the county (city, district) where the project covers an area and is submerged, conduct a physical investigation.

The planning and design unit is entrusted by the project legal person or the competent department of the project to participate in the physical investigation, and after the investigation is completed, the results of the investigation are compiled.

The investigator and the owner shall sign and confirm the results of the physical investigation. The county (city, district) people's government shall publish the results of the physical survey in a prominent position of enterprises, institutions, communities and rural collective economic organizations in the engineering area and the flooded area. The publicity period shall not be less than seven days.

City (state) people's government immigration management agencies, county (city, district) people's government, the project legal person or the competent department of the project, planning and design units and other parties involved in the physical survey shall sign the survey summary document to confirm the survey results, as the basis for determining the task of land acquisition and resettlement for engineering construction. County (city, district) people's government immigration management agencies according to the results of physical examination organization filing card. Article 14 The outline of resettlement planning shall include: the scope of land requisition for engineering construction, the results of physical investigation, the resettlement tasks of rural migrants, destinations, standards and production resettlement methods, the evaluation and prediction of living standards after resettlement, the support policies in the later period of resettlement, the determination of the affected areas above the submerged line, the principles of resettlement planning and the arrangement of resettlement before construction, etc.
