Three reasons for the rejection of Canadian work visas and four regulations that must be observed.

"Express Entry" has become the main way for China students studying in Canada to apply for immigration after graduation, and applying for a "post-secondary graduation work permit" upon graduation is the first step of immigration preparation, but applicants must pay attention to the three traps of rejection of applying for a work permit, including taking courses offered by foreign schools in Canada, taking online courses, and being rejected due to irregular application materials. Steven Meurren, an immigration lawyer, lists three traps that easily lead to the rejection of work visas. He pointed out that many foreign students in China take it for granted that they will be able to obtain a "post-secondary graduation work visa" after graduating from a junior college course, but in fact it is not. He said that the work permit regulations are complicated and there are vague areas in the details. Foreign students should master the tricks before choosing a school, otherwise they may have studied for several years, only to find that the courses they have studied are not eligible for application at all.

The first of the three major rejection traps he listed is that the schools that foreign students attend are not tertiary schools registered in Canada, but courses offered locally by foreign schools. According to the regulations, graduates of such courses are not eligible to apply for a post-secondary graduation work permit.

However, he added that if the school he attended can finally award a Canadian-recognized diploma in education, even if the course includes an overseas exchange course, students will still be eligible to apply for a work visa after graduation.

the second trap of rejection is that if some of the courses are online courses, you are not eligible to apply for a work permit. Wang Xin said that last year, the Immigration Department rejected the application for a work visa from the graduating class of a private tertiary school. The reason for the rejection was that part of the course was an online course. As a result, the rejected students went to the federal court and asked the court to intervene and make a ruling on the relevant incident.

Xin Qin Wang said that the students asked the judge to judge whether the Immigration Department should list the unqualified courses in detail and the proportion of online courses in the whole course before it was considered unqualified. He expects that the federal court or the Immigration Department should give clear guidelines on the proportion of online courses within this year, and before that, he does not recommend international students who want to apply for a work visa to take courses with online learning, so as not to be rejected.

the third trap of rejection is that the information is incomplete when applying. Xin Mengwang said that any application with incomplete information will be rejected. Generally, other immigration applications will be rejected because of incomplete information, and if the applicant's visa is nearing expiration, the applicant has 9 days to apply for renewal of residence qualification; However, recently, some applicants with incomplete information on their "work visas for post-secondary graduates" have not been granted the 9-day arrangement to apply for renewal of residence qualification, so that their student visas eventually expired and they can no longer apply for work visas.

He said that at present, some applicants have taken their applications to the federal court, and it is believed that the federal court or the Immigration Department will give clear guidelines in the near future.

The four regulations must be observed

International students can apply for a "post-secondary graduation work visa" after graduation, regardless of whether they are attending a public or private post-secondary institution, as long as they have studied for eight months or more, and they can apply for a work visa without finding an employer in advance.

The requirements set by the Immigration Department for the qualification of applying for a post-secondary graduation work visa include:

? You must hold a valid student visa when applying.

? Continuous full-time study in Canadian tertiary institutions, but part-time studies may be allowed in the last semester of the course.

? Complete at least 8 months of study.

? You must apply within 9 days after graduation.

As for the validity period of the Post-secondary Graduation Work Permit, it is equivalent to the duration of the courses. However, courses with two years or more can get a work permit with a validity period of three years. For example, international students who have completed a two-year course or a four-year course can finally get a valid work visa for three years.

In addition, it should be noted that the validity period of the work permit depends on the length of the course, and has nothing to do with the actual study time of the students. For example, if a student takes six months to complete an eight-month course, which is equivalent to completing it ahead of schedule, his work permit is still valid for eight months.
