Article 1 (Legislative Basis) In order to promote international cooperation and exchange in education and standardize the appointment and management of foreign teachers, these Measures are formulated in accordance with the Education Law of the People's Republic of China, the Teachers Law of People's Republic of China (PRC), the Exit and Entry Administration Law of People's Republic of China (PRC) and the Regulations on the Entry and Exit Administration of China People and Foreigners.

Article 2 (Definition of Concepts) The term "foreign teachers" as mentioned in these Measures refers to foreigners who are employed by educational institutions, have obtained work permits and residence certificates for foreigners in China, and are engaged in education and teaching in China.

The term "educational institutions" as mentioned in these Measures refers to all kinds of schools and kindergartens, self-study aid institutions and off-campus training institutions established according to law to implement academic education.

Article 3 (Basic Policy) The employment of foreign teachers follows the policy of opening wider to the outside world, employing according to needs, ensuring quality, optimizing service and managing by classification.

Article 4 (Scope of Employment) The posts for hiring foreign teachers should meet the actual needs of education and teaching, and there is a lack of suitable candidates in China, and they do not violate the relevant provisions of the state.

Article 5 (Specific Obligations) Foreign teachers shall abide by the laws and regulations of China, the public order and good customs of China and teachers' professional ethics, and abide by the principle of separating education from religion. The educational and teaching activities and contents implemented shall conform to China's educational policy and basic teaching requirements, and shall not harm China's national sovereignty, security, honor and social interests.

Article 6 (Management System) The education administrative department of the State Council is responsible for the comprehensive supervision of the employment of foreign teachers by educational institutions; The State Council foreign affairs, science and technology, public security, immigration and other administrative departments are responsible for the management of foreign teachers' visas, work permits, entry and residence permits in accordance with the division of responsibilities.

The education administrative department of the local people's government is responsible for the supervision and management of the employment of foreign teachers by educational institutions within their respective administrative areas; The foreign affairs department, the administrative department of science and technology, the public security organ and other relevant departments of the local people's government shall be responsible for the relevant management of foreign teachers within their respective administrative areas in accordance with the division of responsibilities.

Article 7 (Basic Requirements) Foreigners have the necessary conditions to obtain work permits and work-related residence certificates in China, and have the professional qualifications for education and teaching as stipulated in these Measures, and can be employed as foreign teachers by educational institutions.

Article 8 (Qualifications) Foreign teachers should have the necessary academic qualifications and teaching skills to engage in educational work. Among them, those who are teachers of disciplines (including foreign language and literature majors) in various schools at all levels should have a bachelor's degree or above and more than 2 years of teaching experience in related disciplines in relevant educational institutions or work experience in related fields; As a foreign language training teacher, you should have a bachelor's degree or above and have received the corresponding special training in language teaching, obtain the corresponding language training qualification and generally engage in mother tongue teaching in the mother tongue country; If the relevant courses are taught in Chinese, the level of Putonghua should reach Grade III B or above in the Putonghua Proficiency Test Standard, or the corresponding grade certificate should be obtained through the Chinese Proficiency Test.

Foreigners who have obtained a doctoral degree, or a teacher qualification certificate from the country of nationality, or a bachelor's degree or above in normal education may be exempted from the corresponding educational work experience requirements.
