Measures of Guangxi Zhuang Autonomous Region on the Implementation of People's Republic of China (PRC) Water Law (202 1 Revision)

Chapter I General Provisions Article 1 In order to implement the Water Law of People's Republic of China (PRC) (hereinafter referred to as the Water Law), these Measures are formulated in light of the actual situation of this autonomous region. Article 2 These Measures must be observed in the development, utilization, conservation, protection and management of water resources and the prevention and control of water disasters within the administrative area of this autonomous region.

The water resources mentioned in these Measures include surface water and groundwater (including mineral water and geothermal water). Article 3 Any unit or individual shall have the right to report and accuse acts in violation of these Measures. Article 4 The water administrative department of the people's government of the autonomous region shall be responsible for the unified management and supervision of water resources in the autonomous region.

The water administrative department of the people's government at the city or county level divided into districts shall be responsible for the unified management and supervision of water resources within their respective administrative areas in accordance with the prescribed authority.

The relevant departments of the people's governments at or above the county level shall be responsible for the development, utilization, conservation and protection of water resources within their respective administrative areas in accordance with the division of responsibilities. Fifth water permit system and the system of paid use of water resources shall be organized and implemented by the water administrative department of the people's government at or above the county level within the scope of its functions and powers.

The term "water intake" as mentioned in these Measures refers to taking water directly from rivers, lakes or underground by using water engineering or mechanical water lifting facilities. Chapter II Planning, Development and Utilization of Water Resources Article 6 Comprehensive planning of river basins and regional planning of cities divided into districts shall be compiled by the water administrative department of the people's government of the autonomous region, the development and reform department in conjunction with relevant departments and the municipal people's government divided into districts and submitted to the people's government of the autonomous region for approval; Professional planning shall be compiled by the relevant departments of the people's government of the autonomous region, and submitted to the people's government of the autonomous region for approval after soliciting the opinions of the relevant departments of the autonomous region. Article 7 Comprehensive river basin planning and regional comprehensive planning other than those specified in Article 6 of these Measures shall be compiled by the water administrative department and the development and reform department of the local people's government at the city or county level divided into districts in conjunction with relevant departments, and submitted to the people's government at the same level for approval and to the water administrative department at the next higher level for the record. Cross-county comprehensive river basin planning and regional comprehensive planning shall be compiled by the water administrative department and development and reform department of the people's government at the next higher level in conjunction with relevant departments and relevant people's governments at the county level, submitted to the people's government at the same level for approval, and reported to the water administrative department at the next higher level for the record. Professional planning shall be compiled by the relevant departments of the local people's governments at the municipal and county levels, and submitted to the people's governments at the same level for approval after soliciting the opinions of the relevant departments. However, the planning, development and utilization of international border rivers and inter-provincial rivers shall be carried out in accordance with relevant state regulations. Article 8 The people's government of the autonomous region shall establish the database of hydrological and water resources information management system of the autonomous region.

The water administrative department, the ecological environment department, the natural resources department and the meteorological department of the people's government at or above the county level shall, according to their respective functions and duties, establish and improve the network of monitoring stations for water quantity, water quality, precipitation and water pollution of surface water, groundwater and atmosphere, and master the changes of water level, water quantity, sediment, water quality and rainfall. The monitoring data of each monitoring station network shall be shared as required. Article 9 Urban people's governments at or above the county level shall organize water administration, housing and urban and rural construction, natural resources and other departments. Multi-scheme demonstration of urban water supply sources, scientific determination of water supply sources according to the order of surface water before groundwater, and preparation of emergency water supply plans for two or more different water supply sources to ensure the safety of urban water supply. Article 10 If a dam is built on a navigable river or man-made waterway, its ship-crossing facilities shall be maintained and reasonably used according to the principle that whoever invests will benefit.

The people's governments at or above the county level shall instruct the original construction unit to take remedial measures within a time limit for the existing navigation dams. Eleventh construction of water projects need resettlement, the construction unit shall, in conjunction with the local people's government, prepare a resettlement plan, and together with the project design, send it to the relevant competent departments for examination and approval according to law. The approved resettlement plan shall be implemented by the relevant people's governments at or above the county level, and the resettlement work shall be completed in the construction stage.

Resettlement should ensure that the production and living conditions of immigrants are not lower than the original level. The required resettlement funds are included in the project construction investment plan. Twelfth people's governments at all levels should support the construction of drought-resistant water collection projects in water shortage areas. Chapter III Protection of Water Resources, Waters and Water Projects Article 13 With the consent of the water administrative department of the people's government at or above the county level with administrative authority, construction or production operations can be carried out within the scope of protection of water projects that will not affect the operation or endanger the safety of water projects. If flood control, hydrological forecast, drainage, irrigation, shipping, urban water supply and drainage, port operation, fishery ecology and environmental protection are affected in the process of project construction or production operation, and the safety of water engineering facilities is endangered, the construction or production units and individuals shall take remedial measures; If losses are caused, compensation shall be made according to law. Article 14 Construction units or individuals that build, rebuild or expand sewage outlets in rivers, lakes, reservoirs, channels and canals shall prepare sewage outlet setting plans and project environmental impact reports (tables), and submit them to the competent department of ecological environment with the right to examine and approve. Fifteenth people's governments at all levels and their relevant departments and units should strengthen the construction of sewage treatment facilities. Industrial wastewater and domestic sewage of urban residents shall be treated and discharged after reaching national standards.

Drainage to rivers, lakes, reservoirs, channels, canals and other waters shall meet the requirements of water function zoning of the waters.

It is forbidden to discharge waste water and sewage into wells, mines (wells), holes, skylights, leaks and other places connected with groundwater.
